Per the Dawn article, hospital visit order is because SC says IK has an Art.9 right. But SC says IK's family, docs, lawyers can't share medical report w/ media or public, or use it for political purposes or "SC's facility will be withdrawn" (again, as per Dawn reporting)

I mean, leaving aside that IK is a politician, why should any convict not be able to publicise that he is being treated poorly in jail and use that publicity to secure whatever favourable treatment he can? In political cases, SC's jurisprudence continues to be terrible.

Is IK's (or really any convict's) Art.9 right dependent on how he behaves (more accurately, how his family, docs and lawyers behave). And what's the legal basis for not being allowed to publicise a report? Why can't a patient publicise a report?

@HasnaatMalik They can create any number of new courts w/ fancy names, but it makes no difference if they appoint mediocre judges who mindlessly continue the same practices that have brought us to this point (endless adjournments, rewarding dishonest pleadings, staying orders etc.)

@MubarizSiddiqui @SalAhmedPK Both, I think. Some clients have doubts regarding a lower court judge's ability to decide complicated commercial cases. And unfortunately, complicated case or not, most clients will ask me if it's possible that a lower court judge will be bought off by the other side.

The Passports Act, 1974 is a federal law and the Passports Rules, 2021 were made by the Federal Govt. The Rules, 2021 actually already list people who are entitled to official passports in Schedule III which includes serving MPAs till the end of their term (see Entry 1(g))

Laws of Punjab and Sindh Assembly allow blue passports, access to VIP lounges across Pakistan. Punjab law allows even former member for blue passport as well.

Similar question re Punjab Assembly's legislative competence to enact s.17 entitling its members and ex-members to official passports. Again, my initial thought it that it is Parliament that is competent to pass laws re passports (under Entry 6 of Part of the Fourth Sch.?)

That said, I think that political rivals (like Shahbaz Sharif and IK) should be free, for the most part, to engage in mudslinging without defamation suits being filed (nobody sane takes their claims seriously). Would prefer it if the main case was dismissed on merits.

I'm sympathetic to IK's current political situation but I agree w/ Kakar J.'s dissent and don't think it's an attempt to get to the FCC. Firstly, I think majority judgment ignores the standard for review (reviews now are basically just trying to wait out the judges who decided...

without a superior court setting aside that penal action (like in this case). In the context of setting aside DNPs and ex parte orders the words "sufficient cause" might as well not exist. You could probably claim you were abducted by aliens and get a penal order set aside...

Freedom of expression means ppl can produce and show films you find distasteful. I also don't personally believe that making a province look bad is grounds for censoring. The censor board acting inconsistently is another issue but the solution can't be to censor this film.

میں اس صوبے کا نام نہیں لے رہا مگر ایسا پہلی بار نہیں ہوا کہ کسی فلم میں اُس صوبے کی سیاسی قیادت کو منفی انداز میں پیش کیا گیا ہو۔ اس فلم کی منظوری فلم سنسر بورڈ دیتا ہے جس میں ایسے مناظر کو عموماً صوبائی منافرت کی بنیاد پر کاٹ پھینکا جاتا ہے۔
آگے چل کر پھر ایک اور مختلف دھن کے ذریعے اس معاملے کو بیلنس کرنے کی کوشش کی گئی ہے۔

If ever there was a case to invoke the political question doctrine it would be this one. Alternatively, a good case to dismiss for lack of standing (not that Pakistani courts really care about standing (and certainly not this court in this case)).
