في 2017، ارتكب لبنان خطأً اقتصاديًا بنيويًا مع سلسلة الرتب والرواتب:
أقرّ التزامات دائمة على أساس إيرادات افتراضية لم تكن الدولة قادرة على تحصيلها.
الكلفة السنوية كانت بحدود 1.5–2 مليار دولار،
أي أقل من 4% من الناتج المحلي آنذاك.
ومع ذلك، هذا الخطأ كان كافيًا لتوسيع العجز، دفع الدولة إلى التمويل النقدي، ووضع الاقتصاد على مسار الانهيار.

اليوم، في القانون المقترح لمعالجة الفجوة المالية، يُعاد إنتاج الخطأ نفسه، ولكن في سياق أخطر وبكلفة أعلى بكثير.

نحن لا نتحدث عن فجوة بقيمة ملياري دولار،
بل عن خسائر مالية تتجاوز 70 مليار دولار...

في 2017، كان الخطأ قائمًا على إيرادات غير محصّلة.
اليوم، يقوم على أصول غير مُحكَمة ولا محمية ولا قابلة للإدارة.
اقتصاديًا، النتيجة واحدة: مورد لا تستطيع الدولة السيطرة عليه لا يمكن استخدامه لتغطية التزامات حقيقية.

إذا كان خطأ 2017 قد فتح باب الانهيار،
فإن القانون المقترح اليوم يهدّد بإغلاق أي باب للخروج منه.

كل يوم يُهدر في تسويق هذا التضليل كحل،
يرفع الكلفة النهائية على المجتمع،
ويقفل أي نافذة تعافٍ حقيقي.

Lebanon is in sovereign default and a banking collapse. When some members of the current government speak on television almost daily, talking in generalities, selling optimism, and sometimes discussing their personal lives, they are not reassuring the public. They are weakening the country’s position.
In a crisis like this, every public statement matters. Markets listen carefully. They price what officials say and what they avoid saying. Loose talk creates false expectations that Lebanon cannot afford.

That is why Eurobond prices are rising. Not because the economy is improving, but because investors are being led to believe that hard choices will be avoided or pushed onto others.

This is dangerous. It raises the cost of negotiations, hardens creditors, and guarantees a more painful outcome for depositors and citizens later on.
Calm restraint today is more responsible than optimistic talk that the country may not be able to deliver on tomorrow.

سعر اليوروبوند يقترب من 30 سنتًا، وكل تأخير في التفاوض يكلّف الدولة مليارات إضافية. قبل سنة كانت القيمة نحو 3 مليارات دولار، واليوم تقارب 10 مليارات.

ما يمرّ به لبنان اليوم هو تزامن نادر لأربع حالات انهيار كبرى: انهيار مصرفي، تخلّف سيادي عن السداد، انهيار نقدي، وفشل مؤسسي عطّل الدولة. تاريخيًا، واجهت الدول هذه الأزمات كلٌّ على حدة؛ أمّا لبنان فجمعها دفعة واحدة، من دون أدوات فعّالة للإدارة ولا إطار للمساءلة.

الفجوة المالية، المقدّرة بنحو 70 مليار دولار (أي أكثر من 350% من الناتج المحلي قبل الأزمة)، ليست لغزًا محاسبيًا، بل حصيلة سياسات معروفة: هندسات مالية موّلت دولة مفلسة، دعم مهدور تراوح بين 25 و30 مليار دولار شمل الكهرباء والوقود، تخلّف عن سداد اليوروبوند دمّر الثقة السيادية، وتحويل داخلي للخسائر حين سُدّدت الديون بعملة منهارة، فربح المقترض وخسر المودع. هكذا خُصخصت الأرباح وعُمّمت الخسائر.

في هذا السياق، لا يُصلَح ما يُسمّى «قانون الفجوة المالية» بالتعديل، لأن الخلل فيه بنيوي: يبدأ بتوزيع الخسائر قبل تحديد المسؤوليات، فيحوّل ما يُسمّى إصلاحًا إلى تثبيت قانوني للانهيار. المشكلة ليست في الأرقام ولا في النماذج، بل في افتراض دولة غير موجودة: لا مساءلة، لا قضاء فاعل، ولا كلفة على من استفاد. والتجارب واضحة: من دون محاسبة، يتحوّل الإصلاح إلى أزمة مؤجّلة.

لقد مرّ أكثر من 329 يومًا على تشكيل هذه الحكومة. إذا كان المطلوب طيّ الصفحة،
فلتُكتب الحقيقة أولًا.
وإذا كان المطلوب إنقاذ النظام،
فلنُصارح الناس بدل تسويق الوهم.
في اقتصاد منهار بهذا الحجم، الزمن ليس حياديًا: كل يوم تأخير بلا محاسبة هو إعادة توزيع صامتة للخسائر وتآكل إضافي للثقة. المطلوب اليوم قرار واحد لا يحتمل الالتباس: وقف إدارة الانهيار، والبدء فورًا بمسار محاسبة وملاحقة واسترداد يسبق أي تشريع أو توزيع للخسائر. من دون ذلك، سيبقى ما يُسمّى «إصلاحًا» اسمًا آخر لانهيار مُدار.

بعض الملاحظات حول قانون الفجوة المُحال حالياً إلى مجلس النواب. الخطر الجوهري في هذا المشروع لا يكمن في عدم كماله، بل في سوء تصميمه. فإذا أُقرّ بصيغته الحالية، فمن المرجّح أن يقيّد لبنان بأزمة مالية ثانية، أقل ضجيجاً من الأولى لكنها أشد تآكلاً، إذ يستبدل الاعتراف الشفاف بالخسائر بالتأجيل، ويعوّض الحل العادل بهندسة مالية.

1. لا يمكن لأي عملية إعادة هيكلة ذات مصداقية أن تبدأ من دون رقم واحد واضح وشفاف للخسائر.
مشروع القانون لا يستند إلى رقم مُعلن ومُدقَّق بشكل مستقل للخسائر على مستوى النظام ككل. ومن دون تحديد الخسائر مسبقاً وتوزيعها بوضوح بين المصارف والمصرف المركزي والمودعين، لا يعالج القانون الأزمة بل يكتفي بجدولة المدفوعات مع تأجيل الاعتراف بالخسائر. إن إجراء التدقيقات ومراجعات جودة الأصول بعد إقرار قواعد التوزيع يعكس منطق أي معالجة جديّة للأزمات المالية.

2. التمييز بين المودعين يتم بشكل اعتباطي لا وفق التراتبية القانونية.
الإطار المقترح يجزّئ المودعين بحسب الحجم والتوقيت ونوع الأداة، لا بحسب تسلسل قانوني واضح للحقوق. ويُدفع بالمودعين من الفئات المتوسطة والكبيرة قبل عام 2019 إلى مسارات استرداد أدنى جوهرياً، من دون مبدأ متماسك يضمن المساواة في المعاملة. هذا ليس تقاسماً عادلاً للأعباء، بل توزيع انتقائي للخسائر.

3. تجاهل إعادة التوزيع التي حصلت بعد عام 2019 وما نتج عنها من اختلالات.
لا يتناول القانون إعادة توزيع السيولة الدولارية الواسعة التي جرت منذ عام 2019، بما في ذلك حسابات “الدولار الطازج”، والسحوبات الانتقائية، وتحويلات الثروة خلال الأزمة. تجاهل هذه الوقائع يرسّخ عدم المساواة داخل آلية الحل، ويُضفي شرعية على نتائج نشأت أصلاً عن الانهيار الذي يُفترض بالقانون معالجته.

4. الادعاء بأولوية المودعين يتناقض مع الآليات المقترحة.
يُحوَّل المودعون عملياً إلى حَمَلة أدوات طويلة الأجل وغير سائلة، تتوقف قيمتها على سيولة مستقبلية وقرارات سياسية تقديرية. أولوية لا تتحقق إلا بعد عشر أو عشرين سنة ليست أولوية، بل تمديد قسري لآجال الاستحقاق يُفرض على الأسر.

5. الأدوات المدعومة بالأصول أو المرتبطة بالخزينة تقوم على افتراضات متفائلة.
القول بإمكانية استخدام أكثر من 50 مليار دولار من أصول المصرف المركزي لسداد حقوق المودعين لا يستند إلى تقييم شفاف للأصول، ولا إلى تحليل سيولة أو اختبارات ضغط. ومن المرجح، عند إصدار هذه الأدوات، أن تشهد عمليات بيع واسعة في السوق الثانوية، ما يؤدي إلى انهيار أسعارها وخلق فرص مضاربة تسمح للمصارف ولأطراف مطّلعة بإعادة شراء الحقوق بخصومات حادة. هذا نقل للثروة، لا تعافٍ.

6. المساءلة تُذكر من دون تحويلها إلى آليات تنفيذية.
التدقيقات والمراجعات ضرورية، لكنها تبقى بلا معنى ما لم تقترن بعواقب قانونية واضحة، واسترداد للأموال، وآليات إنفاذ تُنفَّذ بالتوازي مع إعادة الهيكلة لا بعدها. إطار يوزّع الخسائر اليوم ويؤجّل المسؤولية إلى أجل غير مسمّى لا يمكنه استعادة الثقة أو المصداقية.

7. الوقت ليس محايداً، والتأجيل بحد ذاته خيار توزيعي.
بعد ست سنوات من تقييد فعلي لودائع الناس، لا يمكن مطالبة المودعين بالانتظار عقداً إضافياً أو أكثر للوصول إلى أموالهم عبر أدوات غير مؤكدة القيمة. في الأزمات المالية، يكافئ الوقت من يملك السيولة والنفوذ، ويُثقل كاهل الأسر العادية. هذا القانون يُضفي طابعاً مؤسسياً على هذا الخلل.

إن التعافي يتطلّب أكثر من الحركة. يتطلّب اعترافاً شفافاً بالخسائر، ومعاملة متساوية للمودعين، ومساءلة فعلية بلا استثناء. ومن دون هذه العناصر، يخاطر القانون المقترح بترسيخ القمع المالي وتهيئة الظروف لأزمة لبنانية مقبلة، بدلاً من حلّ الأزمة القائمة.

وبموازاة ذلك، طلبتُ وضع نسخة منه فوراً على الموقع الإلكتروني لرئاسة مجلس الوزراء وحسابه على موقع X (كما أضعه على حسابي الخاص https://t.co/wB27RKulDH) ليتسنّى لجميع اللبنانيات واللبنانيين، على اختلاف منطلقاتهم ومواقفهم وهواجسهم، الاطلاع المباشر على هذا المشروع بشفافية كاملة، وبشكل وافٍ، ودون أي وسيط.

فمن شأن ذلك، في ظنّنا، أن يبدّد الكثير من سوء الفهم وعدداً من الالتباسات، ويقينا جميعاً من التسرّع وإطلاق الأحكام الجازمة، ومنها ما يكشف عن آراء مسبقة جرى الترويج لها منذ أسابيع.
إن ردّ الودائع إلى أصحابها بطريقة مرحلية خير من تأجيل البتّ بمصيرها، وهو ما يؤول إلى تآكلها وإلى حرمان لبنان من فرصة التعافي والإفادة من الدعم العربي والدولي.

وأكرّر أنّنا لا نبيع اللبنانيات واللبنانيين أوهاماً ولا نخفي الحقائق عنهم. فنحن حكومة أطلقنا على أنفسنا اسم حكومة الإصلاح والإنقاذ، همّنا أن نصدق معكم وأن نكون على قدر ثقتكم. وما كنّا لنعدّ هذا القانون، على صعوبته، لولا خشيتنا من أنّ كل تأخير يسيء إلى مصالحكم... وسنكون منفتحين على الحوار معكم جميعاً اليوم وغداً وبعد غد.

فأنا أدعو السادة النواب وممثّلي الهيئات الاقتصادية والمجتمع المدني إلى وقفة وطنية تقدّم المصلحة العامة على أي اعتبار آخر، فنحن منفتحون على أي اقتراحات تهدف لتحسين ما أتى به هذا القانون، ولكن لا يمكن أن نقبل بالنقد الذي لا يقدّم البدائل، فهذا يساهم في إطالة الأزمة والاستمرار في هدر أموال المودعين وشلل المصارف وتقويض الاقتصاد.

Some reflections on the Gap Law now heading to Parliament. The central risk is not imperfection but misdesign. If adopted as drafted, this law is likely to lock Lebanon into a second financial crisis, quieter than the first yet more corrosive, because it replaces transparent loss recognition with postponement and substitutes equitable resolution with financial engineering.

1. No credible restructuring can begin without a single, transparent loss figure.
The draft law does not anchor itself to a clearly stated, independently verified system-wide loss number. Without an agreed loss figure allocated ex ante across banks, the central bank, and depositors, the law does not resolve the crisis. It merely sequences payments while deferring recognition. Audits and Asset Quality Reviews conducted after distribution rules are legislated reverse the logic of every credible crisis resolution.

2. Depositors are differentiated arbitrarily, not by legal seniority.
The framework fragments depositors by size, timing, and instrument rather than by clear legal hierarchy. Medium and large pre-2019 depositors are placed on fundamentally inferior recovery paths without a coherent principle of equal treatment. This is not burden sharing. It is selective loss assignment.

3. The law ignores post-2019 redistribution and embedded inequities.
There is no treatment of the massive reshuffling of dollar liquidity since 2019, including fresh-dollar accounts, selective withdrawals, and crisis-era wealth transfers. Ignoring this history hard-codes inequality into the resolution and legitimizes outcomes produced by the very breakdown the law claims to correct.

4. Claims of depositor seniority are contradicted by the mechanics.
Depositors are converted into holders of long-dated, illiquid instruments whose value depends on future liquidity and discretionary policy decisions. Seniority that materializes only after ten or twenty years is not seniority. It is a forced maturity extension imposed on households.

5. Asset-backed and treasury-linked instruments rest on optimistic assumptions.
Assertions that over USD 50 billion in central bank assets can back depositor repayment are not supported by transparent valuation, liquidity analysis, or stress testing. Once issued, these instruments are likely to face mass secondary-market selling. The predictable result is price collapse and arbitrage opportunities for banks and insiders to repurchase claims at deep discounts. This is wealth transfer, not recovery.

6. Accountability is invoked but not operationalized.
Audits and reviews are necessary but meaningless without defined legal consequences, clawbacks, and enforcement that run alongside restructuring. A framework that allocates losses today while postponing responsibility indefinitely cannot restore trust or credibility.

7. Time is not neutral, and delay is itself a distributional choice.
After six years of effective deposit confiscation, depositors cannot be asked to wait another decade or more to access their own savings through instruments of uncertain value. In crises, time rewards those with liquidity and access and punishes ordinary households. This law institutionalizes that asymmetry.

Recovery requires more than movement. It requires transparent loss recognition, equal treatment of depositors, and real accountability without exception. Without these elements, the proposed law risks entrenching financial repression and sowing the conditions for Lebanon’s next crisis rather than resolving the current one.

🇱🇧The most important thing to understand about Lebanon’s financial gap law is that its structure is intentional.

This law was not written this way because policymakers lacked better options. It was written this way because better options would have forced them to say the one thing they wanted to avoid: the money is gone, and someone has to pay for it.

In every financial crisis, there is a moment of truth. Losses must be named, priced, and allocated. That moment is painful, but it is the only way confidence ever comes back. The draft law is designed precisely to avoid that moment.

Instead of resolving insolvency, it turns it into a waiting game. Deposits are stretched over many years, tied to asset sales and future performance. The loss is not denied, but it is postponed. And postponement is the whole strategy.

Why postpone?
Because delay allows those who drafted the law to avoid signing their name to an explicit haircut. It allows them to avoid confronting powerful interests now. Doing the right thing would end their political careers, especially for those aspiring to roles beyond the ones they currently hold.

The real question is not whether banks or the state absorb the loss. This law answers that clearly: depositors do.
Not openly, and not once, but slowly and quietly. And in Lebanon, time is not neutral. Time means inflation. Time means erosion of real value. So returning deposits after ten or fifteen years is not returning money. It is returning numbers stripped of their value.

Not because depositors caused the collapse, but because they are the only ones who cannot block delay. They cannot stop inflation. They cannot renegotiate timelines. They cannot exit the system the way others already did.

This is not only a hidden haircut. It is a gradual dismantling of pensions and lifetime savings through inflation and delay.

What is being engineered today is 10x worse that what Riad Salameh engineered before. It is what economists call a confidence trap. Claims still exist on paper, but no one knows what they are worth. When people don’t know what their money is worth, they don’t trust banks. When trust disappears, money stays outside the system, credit never returns, and the economy freezes.

Policies built this way are not meant to restore confidence. They are meant to buy political time. The cost of that time is paid by depositors and by the economy.

At that point, the issue is no longer technical. It is a clear failure of mandate. A leadership that survives by delaying decisions, shifting losses onto depositors, and wasting time it does not own has forfeited its right to remain in charge. It should leave.

Fair point. The fix is simple: replace optimism with constraints. Economics works better when we plan for disappointment. The law should explicitly allocate realized losses ex ante across banks, BDL, and depositors, rather than relying on intertemporal smoothing.
Bank contributions must be capped by post-resolution equity and subordinated liabilities to preserve solvency and recapitalization incentives.
Certificates should be legally defined as state-contingent claims, with payments conditional on verified surplus resources and no automatic sovereign backstop.
The framework must include a codified failure protocol specifying rescheduling or write-downs under resource shortfalls to eliminate discretion and time-inconsistency risk.

Lebanon’s Gap Law is being sold as a solution. In reality, it is a way of avoiding a conversation the country can no longer afford to delay.

Every financial collapse comes down to one basic question: when the money is gone, who takes the loss. This law never answers that question. It spreads the problem over time, wraps it in technical language, and hopes reality will cooperate.

Depositors are handed certificates instead of their savings, but no one clearly explains what those certificates are worth or whether they are actually guaranteed. Banks are told they will help repay them later, even though the banking system is already insolvent. The state insists it is not responsible, yet everyone knows it is the last line of defense when the plan falls apart.

This is not how crises are resolved. It is how they are delayed.

If asset values fall, if banks cannot pay, or if recovery takes longer than promised, the law offers no clear rule for what happens next. At that point, decisions stop being economic and become political. And in Lebanon, political decisions in a crisis usually end with ordinary people paying the price.

Real solutions force clarity early. They tell people the truth, even when it hurts. This law does the opposite. It postpones the reckoning, raises false expectations, and risks turning today’s banking disaster into a much bigger crisis tomorrow.

That may buy time. It will not restore trust.
