Every eviction application must now notify the municipality AND the provincial Human Settlements department
Both MUST join the proceedings.
In practice, more parties = more legal costs + more time.

Courts must now consider elderly residents, children, disabled persons and women-headed households before granting ANY eviction order.

And here’s the part most people may miss.
Asset forfeiture is shifted from “may” to “MUST.”
If you made money organising illegal occupations — the court MUST order it returned to victims.
Building hijacking has a financial model. This clause attacks that model directly. [5/12]

Not just persons collecting rent in a hijacked building BUT, persons who coordinate land invasion; even if they never set foot inside or earn from it.
That is now a criminal offence. R2 million fine. 2 years imprisonment.

It’s the law that governs how and when someone can be evicted from land or a building in South Africa.
It’s been around since 1998.
