Israeli forces killed four Palestinians and wounded several others across Gaza on Saturday, including delivery worker Raed Adel Muhammad Alyan, 24, and another man in a strike on an electric bicycle in Tal al-Hawa, southwest Gaza City.

Yasser Abu al-Khair was killed in al-Amal, Khan Younis, and a fourth Palestinian was killed by Israeli fire in al-Masdar, central Gaza.

Israeli attacks also wounded Palestinians in Nuseirat, al-Mawasi and Khan Younis, including a child, while an Israeli drone struck inside the grounds of Al-Aqsa Martyrs Hospital in Deir al-Balah.

🚨 LA RECALIFICACIÓN DE VALDEBEBAS PUEDE SER TUMBADA EN LOS TRIBUNALES ⚖️

El Ayuntamiento @MADRID de Almeida @AlmeidaPP_ ha aprobado inicialmente la Modificación Puntual del PGOUM de 1997 (parcela DO-190) para que el Real Madrid @realmadrid transforme 448.000 m² de suelo dotacional deportivo en oficinas, hoteles, hospital y universidad privadas: 532.550 m² de edificabilidad (+48%) y una plusvalía de unos 300 millones (Savills: de 70 a 360 M€).

Esta operación es jurídicamente vulnerable por tres razones:

1º. El urbanismo es una FUNCIÓN PÚBLICA.

Los arts. 2.3 y 3.1.b) de la Ley 9/2001 del Suelo de la Comunidad de Madrid subordinan toda la riqueza al INTERÉS GENERAL, y el art. 3.2.h) obliga a impedir la especulación y a garantizar la participación de la comunidad en las plusvalías (art. 47 CE).

Una modificación puntual (art. 69 Ley 9/2001) que suprime el 75% de la edificabilidad deportiva de una dotación para convertirla en usos lucrativos de UN ÚNICO propietario exige acreditar un interés general real y verificable.

Si la motivación es un traje a medida, hay desviación de poder (art. 70.2 LJCA) y procede la NULIDAD.

2º. El precedente de los PARKINGS del Bernabéu ya es SENTENCIA FIRME.

El Tribunal Supremo, por providencia de 24 de junio de 2026, inadmitió el recurso de casación del Real Madrid, con condena en costas, y dejó definitivamente firme la anulación de la concesión de los aparcamientos de Castellana y Padre Damián.

Queda así consolidada la declaración judicial de que aquel proyecto NO satisfacía "una finalidad de interés público y general", sino que respondía esencialmente a los intereses del Real Madrid, "entidad que saldría beneficiada".

Es la misma doctrina con la que el TSJM (sentencia 77/2015) anuló la "Operación Bernabéu" de 2012: vinculación ficticia de parcelas y desviación de poder "con olvido del interés general".

3º. Europa ya se pronunció.

La Comisión Europea, en su Decisión (UE) 2016/2393, declaró que el convenio de 2011 entre Ayuntamiento y club, heredero de la operación de la antigua Ciudad Deportiva, constituyó AYUDA DE ESTADO ILEGAL de 18,4 M€, concedida infringiendo el art. 108.3 TFUE, recordando además que el TSJM ya había concluido que la operación no obedecía al interés general sino "a las necesidades del club".

Aunque el TGUE la anuló en 2019 por insuficiencia probatoria y Bruselas archivó el expediente en 2025, la doctrina permanece: si la recalificación otorga una ventaja selectiva sin contraprestación equivalente, vulnera el art. 107 TFUE y es denunciable ante la Comisión.

CONCLUSIÓN: la modificación ni siquiera es firme, faltan la aprobación provisional del Pleno y la definitiva de la Comunidad de Madrid (arts. 57 y 61 Ley 9/2001), y el plazo de alegaciones sigue abierto.

Con tres anulaciones judiciales ya consolidadas, si Valdebebas prospera sin una motivación reforzada del interés general, los tribunales pueden tumbarla.
