A:KEY FEATURES
1.A landmark constitutional petition challenging Kenya’s public debt as “ODIOUS,” Unconstitutional borrowing of trillions without parliamentary approval,
2.Misuse of Eurobond proceeds
3.Violations of the Public Finance Management Act
4.The IMF applied to be removed from the matter as respondent on grounds of diplomatic immunity. At the same time, the institution did some investigations and presented the Government of Kenya with a report demanding information/explanation of ‘HIDDEN’ and/or ODIOUS Debts. IMF has suspended negotiations based on the report.

1.DECLARATION OF INVALIDITY: Court to declare unconstitutional loans “odious” and unenforceable.
2.PERSONAL LIABILITY: Hold responsible officials personally accountable for repayment.
3.INJUNCTIONS: Stop the Executive from incurring new debts without parliamentary approval and prohibit repayment of existing unconstitutional loans.
