📌It is trite law that depositions in an affidavit which are not challenged are considered as admitted. Constitutional Court throws out an appeal filed out of time without first seeking Court's leave.
COMPANY LAW ALERT: The Supreme Court of Uganda has in the case of CTM Uganda Limited & Ors Vs Allmuss Properties Uganda Limited & Ors, stated that companies should as a matter of practice indicate the names of the members of the company in attendance in the resolutions prepared for registration before the Registrar of Companies @URSBHQ.
The Court further buttressed the need for the Office of the Registrar of Companies to carefully execute its duty by examining special resolutions brought for registration. The necessity to scrutinize such resolutions is to ensure that they were obtained in strict adherence to the procedure set down by the Act.

The sale of motor vehicles in Uganda is not impeded by the vehicle logbook bearing names other than that of the seller.
The High Court of Uganda recently reaffirmed a crucial aspect of vehicle transactions that all vehicle owners and sellers in Uganda must be cognizant of.
Contrary to popular belief, the vehicle logbook does not serve as conclusive proof of ownership. The court observed that possessing the original logbook or a copy thereof is sufficient for a seller to proceed with a sale.
Where the logbook does not feature the seller's name, this does not obstruct the sale; however, the seller needs to provide additional evidence of acquisition, such as a sale agreement. This serves to demonstrate that the seller has the legitimate right to sell the vehicle.
Nevertheless, sellers must recognise the importance of presenting the logbook during transactions, regardless of whether it bears their names. Failure to do so may lead courts to harbour suspicions about whether the purchaser has indeed bought in good faith.
