I can't answer your questions, but I do not believe they are separate issues. Elon has been dead set on SAE Level 5, which is full autonomy, no Remote Assistants in an office somewhere to respond to issues generated by the car itself or passengers. Level 4 requires this remote human backup. Level 3 still requires a licensed driver in the driver's seat. Tesla has declared robotaxis in Texas as Level 4.

The whole point here is that if a private owner wants to have Level 4 operation, it MUST be enrolled in the Tesla taxi fleet. This means Tesla charges for the service even if you are in your own car. A small charge I expect, to cover the costs of the Remote Assistants. If Tesla chooses to allow Level 3, then there would be no extra charge.

One more point, California at this time treats Level 5 as Level 4, that is it must have access to Remote Assistants.

In critical systems there is triple redundancy, so if one fails the vote goes to the majority. In Tesla's case there is some logic for reasonableness to determine which failed. If this is not resolved, then the car pulls over to the side of the road and notifies the driver or Remote Monitors. So the third leg is human.
