This was not a two party consented recording which is illegal in Massachusetts. Akin to the illegal recording made of his call to Karen Read.
Under Massachusetts General Laws, Chapter 272, Section 99, you can only record the call if both parties explicitly consent.
That means the other person must clearly agree after being told it’s being recorded.
Silence or continuing to talk is not considered consent under Massachusetts law — courts have said consent must be actual, not implied. Aidan Kearney has broken the law here.

The defense attorney for Lindsay Clancy, the woman accused of murdering her three children and then claiming psychosis drove her to do it, told Fox News he feels "great" heading into what could be the final day of testimony, and said his client has been "buoyed" by the crowds gathering in her support.
"She's so used to being just beaten down and feeling down and sad," Kevin Reddington said of Clancy's reaction to the supporters. "It was just amazing."
Reddington said he would close the defense case with Dr. Phillip Resnick, whom he called perhaps the world's foremost expert on filicide, the killing of a child by a parent. He said the prosecution would then call three rebuttal witnesses, which he dismissed as "entertainment."
Clancy faces three counts of first-degree murder in the deaths of her children, Cora, Dawson and Callan. She does not dispute killing them but says she was suffering from postpartum psychosis.
Many who have gathered in pink say the show of support is not an endorsement of what happened, but a stand for maternal mental health awareness and for mothers suffering from postpartum conditions.
