In Johnson & Johnson's appeal of Toal's order, she has sent a letter to representation letting them know she did not receive notice of the appeal, that interlocutory rulings are not immediately appealable, and that she expects to be at the pre-trial hearings

Today, SCOTUS denied a writ of certiorari for Marion Lindsey's petition seeking further review regarding denial of state post conviction relief. His execution remains stayed as his 28 USC § 2254 proceedings continue in federal district court.

took a quick look at the docket data to see how long it takes the Court to rule on death penalty rehearing petitions, and roughly there's a median of 40.5 days. based on that, we should probably hear something regarding Bixby's petition around the first week of Nov 1/
