Kaleshwaram HC Order: The Real Picture

Today’s Telangana HC order stopping action on the Ghosh Commission report is NOT a clean chit for Kaleshwaram or KCR.

The Court upheld the Commission’s constitution as valid. It struck down findings only because the Commission violated natural justice, adverse observations were made without giving petitioners a hearing (Sec. 8B, Commissions of Inquiry Act).

This is a procedural win, not a verdict on the project’s merits. The CBI probe ordered by CM Revanth Reddy runs on a separate track, entirely unaffected.
BRS celebrations are premature. Accountability for Kaleshwaram is far from over.

@ArvindKejriwal ‘s attempt to seek recusal of Justice Swarana Kanta Sharma appears less like a principled legal objection and more like a calculated political move. The grounds cited are, at best, tenuous and fail to meet the established standards for judicial recusal.

Raising such objections without substantive basis risks shifting the focus from legal scrutiny to political narrative building. It gives the impression of an effort to reframe the Delhi Liquor Policy case in the public domain rather than contest it strictly on merits before the court.

In this context, Justice Sharma’s decision to proceed with the matter reflects judicial firmness and institutional responsibility. By not yielding to unsubstantiated allegations, the court has reinforced an important principle: recusal cannot become a tool for forum shopping or for casting aspersions on judicial independence without credible evidence.

This episode underlines a larger concern- the increasing tendency to politicise legal proceedings for public sympathy. Such strategies may serve short-term narratives, but they ultimately risk eroding trust in both the judiciary and the legal process.

@havellsindia Your service standards are deeply disappointing and unacceptable. The conduct of your customer care handle @havellscare360 reflects complete apathy towards consumers.

I purchased a Lloyd AC and scheduled installation for yesterday morning. No technician turned up, and there was zero communication from your end. Reaching your customer care itself is an ordeal. On the rare occasions calls connected, your executives failed to provide any meaningful response, merely offering routine assurances of “top priority” without any action.

Subsequently, I received a message assigning a technician along with contact number (08048251313). Despite repeated attempts, the number remained unanswered, rendering the entire process ineffective.

Equally concerning is your silence on social media. Despite tagging your official handles and sending direct messages, there has been no response whatsoever. This reflects a serious lapse in customer grievance redressal.

Please note that such deficiency in service and lack of accountability may attract action under the Consumer Protection Act. I request immediate intervention, failing which I will be constrained to escalate the matter through appropriate legal and consumer forums.

For investors in Indian markets:

Short-term capital gains tax (stocks held <1 year) went from 15% to 20% two years ago.

Long-term capital gains tax (held >1 year) went from 10% to 12.5% two years ago.

And FIIs outflow since then:

2025: Record ₹1.66 lakh crore net - the highest annual FII outflow ever recorded in Indian markets.

2026: ₹1.51 lakh crore net just year to date.

Just a 2% increase matters a lot if you are an FII investing billions. FIIs invest in India because of high growth opportunities, but a depreciating rupee and an increase in taxes means they may move out their capital.

And FIIs definitely move their capital when they sense global issues may drag India's growth. We are already seeing this. This causes more stresses to India's economy, currency, and companies.

Even if futures and options keep their increases in STT (for various reasons it can be argued to make sense), for capital gains from equities, this increase in tax definitely needs to be reconsidered by GoI.

An idea I propose is the increases in taxes can be applied (some other way) only for FIIs, and only when they are taking out the capital from the country. Not sure how it can be implemented, or if it is even practical.

If not, the increases in CGT must be reconsidered, and reverted for at least the time being, to incentivize FIIs and DIs in investing in India's growth story.
