Metcalf’s family showed more restraint than most people ever could.

I’ve lost count of how many times I’ve made this point, but please take this as a WARNING, and not merely an observation: Anti-social behavior—think about the guy blasting music from a speaker, talking loudly on speaker-phone, smoking inside the subway car, etc.—in public spaces is often engaged in ***_as a dare_***. The whole point is to provoke anger and annoyance in those around him, which serves two purposes, depending on the response he’s hoping for:
(1) If everyone bites their tongues, the antisocial asshole gets to tell himself he’s such a badass no one would dare speak up; or
(2) If someone confronts him, he finds his excuse to scratch a violent itch.
Understand that saying something to these people will often come with a real risk of violent confrontation.

Its entire argument is:
Defendant A was white.
Defendant B was Black.
The outcomes were different.
Therefore racism.
That’s not evidence. That’s an accusation.
To prove racial bias, you would have to demonstrate that the material facts were substantially the same, the evidence was substantially the same, the legal standards were substantially the same, and the juries ignored those facts because of race.
This graphic proves none of that.
It simply places two photographs side by side and asks you to reach the conclusion emotionally.
Notice what is missing:
The trial transcripts.
The jury instructions.
The forensic evidence.
The witness testimony.
The prosecution arguments.
The defense arguments.
The legal distinctions between the cases.
None of it is here.
Why?
Because if the evidence alone proved racism, they would show the evidence.
Instead they show race.
The moment someone says two verdicts are racist because the defendants had different skin colors, they have already abandoned the legal argument and moved into the realm of political storytelling.
The American justice system does not sentence people according to race.
It sentences people according to what twelve jurors believe prosecutors proved beyond a reasonable doubt.
If this meme has to hide thousands of pages of evidence to make its point, then the meme is the weakest part of the argument.
Race is not proof.
A side-by-side collage is not proof.
Evidence is proof.
And this graphic provides almost none.
