Hon'ble CJI has elevated the affirmative action (Reservation System) to greater heights. CJI has ruled that, Article 14 of our Constitution permits sub categorization of not similarly placed classes of citizens while we were confining ourselves to seek sub categorization under Article 15 (4) and 16 (4) Only.
Now, 7 Judges Constitution Bench headed by CJI DY Chandrachud has ruled that, Article 14 itself permits sub categorization of not similarly placed classes of citizens. What does it mean?
This new interpretation of Article 14 of our Constitution means, the Constitution of India permits internal reservations by way of sub categorization of not similarly classes of citizens not only under Article 15(4) and 16(4), but also under Article 39(b) and (c), Article 46, 330 and 332. The scope of internal reservations is expanded widely to ensure adequate representation of different Caste Groups in the fields of education, economic development and for political representation also.
This means, internal reservations can be provided in respect of economic empowerment schemes, for elections to TP, ZP, Village Panchayats, MP and MLA seats also. Article 14 covers all segments of opportunities. 😊😊
