आज आधी रात को जयपुर RTO द्वारा हमारे साथ बेहद शर्मनाक और अपमानजनक व्यवहार किया गया।

हम अपनी फैमिली, महिला सदस्यों और अपने डॉग के साथ सीकर से जयपुर आ रहे थे। खेतान हॉस्पिटल, VKI 7 नंबर के पास हमारी प्राइवेट गाड़ी को RTO विद्याधर नगर के अनिल बसवाल साहब द्वारा रुकवाया गया।

उन्होंने हमें बताया कि “जयपुर में 18 Hilux गाड़ियाँ सीज़ की जा रही हैं। कलेक्टर के आदेश पर इन गाड़ियों को चुनावों में उच्च अधिकारियों के लिए लगाया जाएगा।” इसी आधार पर हमारी गाड़ी भी सीज़ करने की बात कही गई।

हमने बहुत रिक्वेस्ट की कि हमारे साथ महिलाएँ हैं और हमारा डॉग भी है। हम आधी रात को बीच रास्ते में कहाँ जाएंगे? हमने कुछ मिनट इंतज़ार करने की भी विनती की, लेकिन हमारी एक नहीं सुनी गई और हमें गाड़ी से नीचे उतार दिया गया।

सबसे दुखद बात यह रही कि हमारे साथ मौजूद महिलाओं के साथ भी कथित तौर पर बेहद गलत और अभद्र व्यवहार किया गया। मेरे छोटे भाई को FIR की धमकी दी गई और मेरे साथ “लंदन जाकर दिखा” जैसी बातें कही गईं।

इस पूरी घटना की हमारे पास ऑडियो रिकॉर्डिंग भी मौजूद है। घटनास्थल पर मौजूद आम लोगों ने भी पूरी घटना देखी और उन्हें भी पता है कि हमारे परिवार और महिलाओं के साथ किस तरह का व्यवहार किया गया और हमें आधी रात को बीच रास्ते में कैसे रोका गया।

हम इस पूरे व्यवहार से बेहद आहत हैं। हम संबंधित अधिकारियों से इस मामले की निष्पक्ष जाँच, घटना की रिकॉर्डिंग की जाँच और जिम्मेदार अधिकारी के खिलाफ उचित कार्रवाई की माँग करते हैं।

FIR is an allegation. Not a conviction. And the Supreme Court has repeatedly said it clearly … the power to arrest is NOT the necessity to arrest.

In Arnesh Kumar case , the Court said police must ask three basic questions …

Why arrest?
Is it necessary?
What purpose will it serve?

So the same logic applies here…
The alleged “evidence” is a social media video. It is already public. So why the 2:35 AM arrest?

Was he going to delete a video that thousands had already seen? Destroy evidence sitting on the internet? Flee the country?

Or was arrest simply the easiest thing to do once the FIR was filed? Or was it an ego satisfying exercise of power?

Article 21 matters. Personal liberty is not a favour the State grants … it is a constitutional right.

Article 22 matters too. It exists precisely to protect citizens from arbitrary arrest and detention.

But who cares about Article 21 and Article 22 when politicians allegedly weaponise the police to silence critics, settle political scores and satisfy their egos?

The very politicians who claim to be the “saviours of the Constitution” are accused of using the machinery of the State against those who question them.

When will this issue be permanently resolved? What steps or guidelines are EPFO planning to implement.
