🚨 US Section 301 to Impose 12.5% Sanctions on India, Face Strong Pushback from India Amid Ongoing Trade Talks

As India and the United States move closer to concluding a bilateral trade agreement, fresh trade tensions have emerged after US initiated two new investigations under Section 301 of the US Trade Act of 1974. The probes target Indian exports worth nearly $6–7 billion, focusing on allegations related to forced labour and excess manufacturing capacity.

The forced labour investigation alleges that India has not taken sufficient measures to eliminate forced labour practices in parts of its manufacturing sector. The second probe argues that Indian subsidies and industrial policies create excess production capacity, allowing cheaper exports that allegedly disadvantage American manufacturers. If these findings are upheld, the United States could impose an additional 12.5% tariff on affected Indian products, over and above any tariffs agreed under a future trade deal.

India has responded with an unusually firm rebuttal, challenging both the legal basis and the evidence behind the investigations. India has argued that the US has failed to identify any specific Indian law, administrative practice, or documented violation that justifies the allegations. It has also questioned the absence of concrete evidence showing that Indian exports have caused measurable harm to American commerce or industry.

India further criticised what it described as an inconsistent approach by Washington. While launching broad investigations, the US simultaneously exempted nearly 1,600 products, including commodities such as coffee, cocoa and vanilla, from the scope of the forced labour probe. Indian officials argue that such selective exemptions undermine the credibility and consistency of the investigation.
