Ude v. Nwara (1993)
If you’re a lawyer, you need to learn the art of disagreement (it really is an art). Before you disagree, you need to acknowledge what you and the other side agree on, especially when you have an audience (people hate feeling like they haven’t made any sense). So, acknowledge what they’ve done or said that’s correct or right - it disarms them, and then go on to disagree. Many times when people say they disagree, they actually don’t disagree entirely, they disagree only to an extent (so it is a degree issue). You get a better outcome, when you start with, I agree with you that x is y, but… (and then you go on to add your perspective or dissent).
A billionaire businessman in Bayelsa publicly promised to send the brightest Bayelsa youths to the United States for pilot and aircraft engineering training.
776 people applied.
Only 2 passed the exam.
According to one of the winners, instead of being sent abroad as promised, they spent 16 months working for him, doing everything from aviation tasks to running errands.
The matter is now before the courts.
A Nigerian lawyer who is not a customer of Guaranty Trust Holding Company PLC (GTCO) or any of its subsidiaries, began receiving text messages of targeted ads, from GTCO.
Worried that there might have been a data breach of his personal information leading to the disclosure of his phone number to GTCO, especially because he does not operate a bank account with their subsidiary, Gtbank, he then lodged a complaint to GTCO, demanding that they desist from sending him text msgs of targeted ads; and that GTCO discloses their source of his personal information, in this case his phone number.
GTCO acknowledged his complaint, but failed to satisfy the demands, and continued to send targeted ads to his phone number.
He sued. Alleging violation of his right to privacy. The court agreed with him.
Amongst the Orders granted by the Federal High Court, was an Order directing GTCO to disclose their source of the Applicant’s personal information.
"Courtroom drama today with my landlord's lawyer"
A very senior lawyer who manages the house I currently live in appeared for the Defendant, while I appeared for the Plaintiff.
I raised a robust objection seeking to have the Defendant's process discountenanced.
Unfortunately, the court was not persuaded and refused the application.
After court, the learned senior walked up to me and jokingly said:
"Counsel, hope you still remember that I'm the one managing the house you're staying in?" 😂😂
Counsel: I pray My Lord's indulgence to ask the witness about 3 questions and adjourned for continuation of trial.
Court: why?
Counsel: My Lord I have not had breakfast
Court: counsel take date 🤣🤣
