Rhetorical question . . . If @Ripple had ACTUALLY conducted a ICO (that’s an “initial coin offering” to the public for the uninitiated), do you think the @SECGov might have been a tad bit more successful in its 4.5 year litigation against @Ripple? 4.5 years.

@ripple was found to have sold XRP under a contract (or series of contracts) to institutional investors. That’s it. See Summary Judgement Order, page 18.

And here’s the worst part of it all . . . Even assuming XRP was a security for the purposes of these sales (the court found as a matter of fact that XRP was NOT a security BTW - but let’s leave our brains on the floor for a moment), do you know what the securities laws consider a sale only to “Accredited Investors” (a fancy defined term that means big rich kids like Institutions) - irrespective of the number of investors involved in the deal???

Anyone? Bueller?

And - here’s the REALLY tough part . . . The people you LOVE and admire the most, that you believe are the “leaders of the XRP Army” served (whether knowingly or not) as controlled opposition this entire time. They told you what you wanted to hear, and never did a thing for you . . . But monetize you.

It’s tough to hear the truth, I know. And, I know I’ll get the same fools that have no knowledge of the law squawking and calling me a fraud etc etc.

I never monetized you.

Nor did I build a public persona on your back by telling you lies about all the wonderful things I was doing for you.

I told you the truth.

Stay away from the blue pill, Neo. It hurts worse when you find out your best friend lied to you for years.

P.S. I do believe we are pulling up out of this dark decent we’ve been living through, since 12-22-2020. I have faith that the @realDonaldTrump Admin is doing their very best to straighten this all out, and it’s gonna take some time. The other side (more broad and evil than just saying the “democrat party” - although they all seem to be very much involved) fucked this all up so royally . . . It’s just going to take a little time to work it all out.

Didn’t have to be this way. But, it is. 🤷‍♂️

P.S.S. The real question for me is why didn’t @Ripple, with all of their incredibly “High priced” legal counsel, just plead the Private placement as an affirmative defense - “Yeah, we did that! And it was a perfectly legal private placement of XRP.” - and give the @SECGov the fucking “Heisman.”

I promise you there are legal memos to @ripple plainly laying this potential defense out.

But they didn’t go there.

I’ve thought about this a ton. And, the only thing I come up with is that it was just too important for @ripple to maintain a position that XRP was NEVER EVER - no kidding, no fooling - NEVER EVER EVER EVER . . . a security. No matter what, full stop.

And, if that was the reason, well, they won. “XRP is not, in and of itself, a security.” Never was. Never will be. They’ll pay a little tip to the govt, but absolutely won the war!

So, they were right.

What do you say @s_alderoty? @bgarlinghouse? For old times sake. What’s the story there?

Don’t answer that (not that the lawyers would let them - LOL).
