Also, Cda has 2 tier justice/rights, so the rule of law can not be applied where country doesnt treat all ppl equally

Exactly so! Constitutional rights are merely carve-outs to the general rule that the state's authority is unlimited.
A short excerpt from my upcoming article: "For a free country, flip the default. Instead of giving the state unlimited authority and trying to grant "rights" to hold it back, do the reverse. Give the state no powers except as the constitution specifically grants. Everything else is the exclusive domain of individuals."
That's the concept. Now, what's the execution? What limited powers should the state have? How will government work if legislatures do not have a broad power to legislate for the common welfare?
