-Kiambu Club that started in 1916, the British Government grants a Lease of 33 years in 1956, in 1989 it is renewed for 33 years till 2022✅️
-2 years to Expiration in 2020, the Club submits a renewal application with all conditions met.✅️
-The County in its beaurocracy fails to do so, and in 2024 decides that their condition for renewal is that the Club cedes 20 of its 75 acres to the County for 'Public purposes', to build markets, schools, hospitals they say.
-The Club says no, just compensation for that, since our renewal has a legitimate expectation on it. We have also been paying rent & you take it. So there is periodic tenancy. The County through MCA organizes protests in 2024 & the Club amenitities are vandalized. ✅️
-The Club moves to Thika ELC but via a Constitutional Petition, the County says no way, go through a Civil Route or at least JR, this is a civil dispute, oh yes Constitutional avoidance applies, Plus you're not a person capable of protection under s13 of LA through premption rights;

1. The Club is a person under Article 260 and all rights inclusive property rights are open to them 🔎
2.When Constitutional violations arise even in commercial/contractual engagements, the Constitutional Petition route is open, Jovet of the Supreme Court is cited🔎
3. 109 years of renewal and lawful compliance, done in time & all conditions met, the County was bound to fulfil the legitimate expectation.
4. The demand for 20 acres without NLC being involved and just compensation, the same was unconstitutional & capricious. The delay to renew and later claim it has reverted back without lawful procedures is unfounded 🔎
5. Periodic tenancy was proved, receiving rent & consent to occupy beyond the Expiration. ✅️
6. Court orders for renewal in line of the procedures and conditions in 90 days.✅️
7. The letter reverting the Land back to County is quashed. ✅️
8. General damages of Kshs 3,000,000
9. Petition succeeds. ✅️
