Britain now has an Islamic blasphemy law via the backdoor, thanks to the Government's official definition of Islamophobia — now repackaged as "anti-Muslim hostility".

From the start, the Free Speech Union warned that any such definition would have a chilling effect on free speech and stifle our right to criticise, debate, and mock religion in this country.

We were proved right almost immediately. Since the definition was published in March, it has been used by activists and Labour MPs to silence legitimate criticism of Islam. When the Shadow Justice Secretary, Nick Timothy, criticised a mass Muslim public prayer event in Trafalgar Square, he was branded an Islamophobe, reported to the Parliamentary Commissioner for Standards, and even faced calls to resign from the then Prime Minister, Sir Keir Starmer.

The Labour Government did not consult Parliament about its plans to revive Britain's blasphemy laws for Islam alone. At the start of the year, the Free Speech Union exposed that all five members of the Working Group tasked by Angela Rayner to draft the Islamophobia definition had troubling links to Islamist organisations. These include the Muslim Council of Britain and MEND, both of which are subject to a government policy of non-engagement over concerns about extremism.

What is even more concerning is that it is almost certain extremists were able to influence the drafting of the definition. If that is not alarming enough, Nick Timothy's Freedom of Information (FOI) request has revealed that the Communities Department deleted all the responses to the Working Group's consultation on the Islamophobia definition.

If there is nothing to hide, why did the department delete all the responses — a move that appears to breach its own policy on data retention?

There are serious questions for Angela Rayner and her department to answer. Why did they delete all these responses? Did ministers direct officials to dispose of the submissions? Did extremist groups really have the chance to influence the definition, while the Free Speech Union and the Equality and Human Rights Commission (EHRC) did not?

The public deserves to know the truth.

PLEASE my friends ask yourself a simple question. Why would a government spend public money in court to stop the public seeing a migrant data spreadsheet?

A think tank asked the Ministry of Justice for the figures on offences committed by foreign nationals between 2018 and 2024. The MoJ said no. The Information Commissioner looked at it and ordered the department to hand it over.

That should have been the end of it. Ruling made, data released, argument had in the open like grown-ups.

Instead, Burnham’s government is appealing. Lawyers, court time, your money, all deployed to keep a file shut that the regulator has already said belongs to you.

And remember what this file is. Not a research project. Not some vast new collection exercise costing millions. It sits on the Police National Computer already. Denmark publishes this. Germany publishes this. Sweden publishes this. Somehow only in Britain is it a state secret.

Victims have now written asking for it, like my friend Siobhan Whyte, whose daughter was murdered by a hotel migrant. People who were attacked, whose families were destroyed, are being told the numbers are too dangerous for them to see. Think about what a government has to believe about you to take that position.

It’s probably worth saying at this point something I’ve said before, lest it gets lost in the sands of time and political rhetoric about immigration and illegal entry, and how we got to this point.

I was an immigration officer in the 1970s and 1980s. The power to grant or refuse leave to enter was vested to me in law under the authority of a Chief Immigration Officer. Anyone arriving without a valid passport (and a visa if required) was refused entry at the border, detained, and removed on the next available ship or aircraft whence they came. This was under the Immigration Act 1971 (still
In force although amended massively by successive governments ever since). It was some 20 - 30 years after the 1951 ECHR and the 1951 Refugee Convention was signed.

Nobody claimed asylum. Nobody claimed human rights. No country refused to take people back. Those who had destroyed their passports were removed on a letter, signed by me.

Fast forward 50 years and now anyone who arrives at the border without a passport or a visa automatically claims asylum or human rights. Immigration Officers of today (or Border Force Officers) are thereby disempowered to send them back before their asylum claims or human rights claims are considered. And their appeals are dismissed. They cannot be detained in the meantime because under the Hardial Singh principles immigration detention is only lawful if there is a realistic prospect of removal within a reasonable period of time. Which there isn’t of course. So the only option available to the officer is to grant temporary permission whilst these applications are considered. And if the applicant claims to be destitute they must be given support and accommodation at public expense. Because failure to do so would put the government in breach of A3 of the ECHR (inhuman and degrading treatment). And even if the applicant is eventually refused protection - and loses their appeal - we need to get a passport to remove them on. And they often refuse to comply with the documentation process. Even if they do many countries still refuse to issue them with a passport and refuse to take them back. And even after all this they can abscond and if ever caught start the whole process again.

This is where we are and so far no government has been able to break the Gordian knot that ties the hands of our officers. In order to do that they would have to reverse decades of laws and judgements - and demur from long held well intentioned international conventions. And probably look at the British Constitution itself to curtail the opportunity of political opponents to use the courts to thwart the will of Parliament.

This is not to criticise or favour any political party or policy. It is simply a matter of record to inform the next generation of politicians and the civil servants charged with the duty of implementing any new laws or policies they may introduce.

And to ask why - if we did it back in my day - why can’t we do it now?

I even wrote a book about it. I hope someone keeps a copy for posterity - or even history - when thinking about how to fix this seemingly intractable problem.

Physio is a forty week wait. Your back does not have forty weeks.

Schools teach in portable cabins bolted to the playground because the actual building is held up by aerated concrete and hope.
Half of them are technically insolvent.

Parents fund the reading books, the glue sticks, the photocopier, the roof and increasingly the teachers wages - all via a PTA raffle and local fundraisers.

The state offers “free” childcare hours that don’t cover the nursery’s costs, so the nursery bills you a “top up fee” for the free thing.

Shoplifting under £200 is functionally legal, so Tesco hires guards - who crucially don’t even try to stop it - and you pay for them in the price of the milk.

999 takes an hour, so you buy the Ring doorbell, gather the evidence, file the report and get a crime number for the insurance you also pay for.

Court backlogs run to years, so anyone with money settles privately and everyone else gets nothing.

Legal aid is gone. Represent yourself.

Passport and DVLA backlogs are chronic, so the state sells you a fast track service to escape the queue the state created.

The trains are late whoever owns them, so you drive on the roads with the potholes.
Public toilets are shut, so you buy a coffee you don’t want.

The library is staffed by pensioners working for free.

Street lights are switched off at midnight to save money in a country with a burglary charge rate near zero.

You pay National Insurance for fifty years and they move the pension age.

You pay the adult social care precept every year and then sell your mother’s house to pay for adult social care.

Leaseholders pay for a “waking watch” because the state signed off the cladding and then billed the residents to fix it.

Social housing sits on the most valuable land in Britain, allocated by need rather than proximity to work, 48% of zone 1 social housing is occupied by foreigners mostly welfare dependent - while the nurses, teachers and other workers who keep zone 1 running commute ninety minutes each way from Kent because we stopped building anything in 1979.

Every one of these is a service you have already bought. The receipt is your payslip.

The tax burden is heading for its highest sustained level since the 1940s. The service level is the worst in living memory.

You are not overtaxed or underserved. You are actually BOTH, simultaneously, and the gap between the two is where your standard of living went.

The state has become a subscription you cannot cancel and cannot use.
