@jwludwig@mirandadevine 3. There is no scientific basis to determine that at a particular BAC a person is incapable of making decisions/giving consent. But I agree that young men should avoid have sex with intoxicated women, lest drunken consent be converted to rape after the event.
@jwludwig@mirandadevine 2. At any event, incapacity to consent due to intoxication already (and logically) means lack of consent. In the present case, it would depend on BAC at the time of the intercourse and whether she was incapable of consent at that particular time.
