I agree with you one hundred percent.
I made people sign contracts for small business I was frowned at. Found one working for my competitor without my knowledge and still having my business things after holding them accountable.

In Zambia, generally, people don’t respect contracts, it took me some time and a series of events to realize this.

The guy who swindled me K120,000 had a fully signed agreement, issued 8 post dated cheques, but still breached that agreement. The last time I heard about him was when a famous newspaper carried his headshot two years ago that he was “missing”. I’m told he is alive and well.

When I co-owned a division one football team, all our players were on contracts. Somehow, these players still got released, successfully transferred to other Clubs without my knowledge and I wouldn’t know a thing. On one occasion, I saw (on Facebook) a player getting unveiled as a new signing at a super league club on the Copperbelt, another striker was in the starting lineup at another super league club in Lusaka & many more. Money had exchanged hands, contracts breached but people still carried on with life, it was business as usual.

Our annual expenses as a team were on average $15,000. This gent who was part of the coaching staff came up with a great idea. He had bought a bus from Japan but had no money to clear it. He suggested I help him clear it on the understanding that we would share profits every month and this bus would be used to transport players on weekends. I loved this idea, without hesitation, I wired K70,000.

This bus was on the road for only 3 weeks. In that period, we “replaced” tires, changed part of the suspension until miraculously, the gearbox died and it was taken to an unknown garage to be “fixed”. I was told the mechanic had recommended replacing the auto gearbox with a manual one, this would need K42,000 😃. I went to court and this gent told the court he’d pay me back my investment, it took time to get this money because as you know, our courts are flexible. When the matter went to court and I was successfully removed from the agreement, that bus suddenly stopped having issues, it moves freely between intercity and Chelston.

Why am I writing all these things? It’s to encourage you to look beyond contracts, our market is gone and people have become generally bad to a point that a piece of paper can’t protect you. Doing business remotely, I don’t recommend, if you’re not on the ground, you’ll cry. Be safe and invest wisely.
