The Court observed that the validity of the sale had already been litigated and conclusively determined in Civil Suit No. 0684 of 2019, where the Court upheld the mortgagee's exercise of its power of sale.
The Court reaffirmed that, under Sections 27(4) and 28(1) of the Mortgage Act, a purchaser at a mortgage sale acquires good title free from prior encumbrances, save in cases involving fraud, misrepresentation, or dishonesty.

The suspect has been identified as Kabugo Henry, a 21-year-old boda boda rider and resident of Old Kira–Kisenyi.
Preliminary investigations indicate that Kabugo Henry was captured in video footage of the incident wearing a blue reflector jacket and concealing his face with a black hood.
The suspect was arrested in the Wandegeya area of Kampala in a joint operation involving Police and boda boda leadership from Nakawa Division.

Earlier today in the Parliament of Uganda, Member of Parliament Hon. Andrew Oulanyah, also Vice President of Uganda Rugby, rose on a matter of national importance under Rule 56.1 of the Rules of Procedure regarding the death of the Late Rugby Cranes and Stanbic Black Pirates player, Sydney Gongodyo.
The father of the late Sydney Gogonya said emotionally that the only time his son disappointed him was when he found out he played rugby. As a lawyer, he had never wanted him to play the sport.
This is bigger than Sydney.
For years, we have watched incidents of mob justice happen on our roads. Sometimes the victim survives. Sometimes they don’t.
The truth is that many boda boda riders are hardworking men and women trying to earn an honest living and provide for their families. We have brothers, sisters, fathers, mothers, and friends in this business.
But we must also be honest and admit that mob justice has become a serious problem that needs to be addressed.
When an accident happens, when there is a misunderstanding, or when emotions run high, the answer cannot be violence.
No one should have the power to decide who lives and who dies on the side of a road.
This is why I believe there must be more engagement with boda boda associations, community leaders, police, and local authorities. We need education, accountability, and a clear message that mob justice is not justice.
One life lost is one too many.
Today it is Sydney. Yesterday it was someone else. Tomorrow it could be someone’s brother, sister, husband, wife, son, daughter, or friend.
Uganda can do better. We must do better.

The suspects have been identified as Mugwiisa Obed and Owino Joseph, a security guard. Mugwiisa Obed was captured in video footage wearing a yellow T-shirt and carrying a large log during the incident. During interrogation, he led investigators to a local laundry (dobbi) where he had taken the yellow T-shirt he was seen wearing on the day of the attack. The garment was subsequently recovered as part of the ongoing investigations.
Their arrest brings the total number of suspects currently in custody to ten (10) as investigations into the alleged mob killing continue.
Efforts are ongoing to identify, trace, and apprehend other individuals believed to have participated in the incident.
We remain committed to ensuring that all those responsible for this criminal act are held accountable and brought to justice in accordance with the law.

High Court at Mbale Holds That a Vendor Who Double-Sells Land to Different Purchasers May be Held Liable to Compensate the Dispossessed Purchaser at the Property's Current Market Value.
The learned Judge found that since the 2nd Respondent had sold the same land to two different purchasers, it bore responsibility for the consequences of the double sale.
The Court clarified that a purchaser who loses the property due to an earlier competing interest is entitled to seek compensation from the vendor who wrongfully conducted the subsequent sale.
The Court therefore found that the Appellant was entitled to recover the value of the land from the 2nd Respondent.
