Protecting #Consumers and Genuine Manufacturers: Please Close the Labelling Loophole
A growing concern in our sector is the misuse of labelling laws, where repackaged imports are legally passed off as “Made in India.” Under current definitions in the Drugs & Cosmetics Act and Medical Device Rules (MDR) 2017, activities like labelling and repackaging qualify as manufacturing.
This loophole:
• Misleads consumers about product origin and safety
• Undermines genuine manufacturers who invest in infrastructure and quality
• Renders the Public Procurement Order (PPO) ineffective by allowing pseudo-manufacturers to claim domestic preference
We respectfully propose:
• Amending the definition of manufacturing in Medical Devices Rules 2017 and in Packaging Rules under Legal Metrology Act to exclude mere labelling and repackaging
• Strengthening labelling rules to disclose:
o Actual country of origin
o Original manufacturer’s name and address
o Nature of value addition in India
o Supplier classification (e.g., >50% or >20% domestic content)
• Enforcing transparency through random audits, QR-code traceability, and certification of the @makeinindia logo by @QualityCouncil
• Educating consumers @jagograhakjago through public awareness campaigns and support for publications like #AwareConsumer @bejonmisra
India’s #medicaldevice sector has the potential to be a global leader. But that future depends on trust, transparency, and fairness. Let us ensure that every product claiming to be Indian made truly earns that label
