Byrider is the rare outfit boasting that, in an ideal world, anyone who patronizes one of its dealerships will never have to do so again https://t.co/bQkE9iCtXp
@hxxntrr Couple of problems with your claims:
1. Can’t stack claims. If you have a valid claim, you can win a maximum of $1,000 per statute. 5 claims? Still $1,000
2. Cannot collect Attorneys fees unless you are an attorney
3. Can’t collect court costs unless you actually acrue them.
@Soulful1865 Yeah, actually this is a great lawsuit against the repo man. If you told a repo man to stop his attempt to take your vehicle and he did so against your demand, you may have a case! https://t.co/dUuWofZqYW
@GuyDealership@FullpathCDXP Yeah, but get this. If a repo agent violates UCC Title 9 during a repo, that expensive credit instantly turns into your statutory award (9-625) by allowing you to sue for the entire interest amount plus 10% of the original principal. Repo agents must not breach the peace.
Hey Democrats! We need a NEW #FDCPA! It has been decimated by really bad court decisions because judges wrongfully believe any case must meet Article III standing to be filed. A violation of the statute alone is not actionable, destroying consumer protections/rights.
The Act MUST BE CLARIFIED so that the intent of congress is clear/ a violation of the act is enough to bring a private right of action, the act must bring financial pain to collectors that make abuse a business practice, and finance the @FBI to go after bad paper scammers.
