How to Learn First Principles of Laws when these are not expressly stated so in reported judgements? How Two First Principles of Law can be seen in a recent judgement of Supreme Court.

Let me begin this post by telling you when did I first heard the words "First Principles of Law".

" I would prefer to go by First Principles of Law", replied former Chief Justice S H Kapadia to a Designated top Senior Advocate who was trying to show some unusual judgements of Supreme Court which were against the common sense of law.

I was then sitting in First Court and I was trying to understand the arguments.

There, I first heard the words "First Principles of Law".

Then I thought more and more about these words. I wondered how I too can learn First Principles of Law and from where.

Then I read a First Principle of law in Lord Denning's book. He said something like this,

"Limitation to file a case, must start from when a litigant acquires capacity to file a case.... When a person learns that some order is passed against him and when he gets a copy of order, then only he can challenge that order".

I considered this as a First Principle of law.

Then I saw that today, there many Acts and Rules which are against this first principle of law. These Acts and Rules says that the "Limitation to file a case starts from the date of order and not from the date of knowledge of the aggrieved parties".

I started looking at such laws and rules as contrary to the First Principles of Law.

Then I remembered to have read a judgement of former Chief Justice P N Bhagwati. As I understood, he said something like this, "All procedural laws are only maid servants of Justice."

I regarded this as the First Principle of Law.

It means that the procedural laws and technicalities should not come in the way of a judge when he is trying to pass a just order. It means that no judge should deny justice to a party on the ground that some procedural technicalities are not followed.

Then whenever I came across a judgement where a party was denied justice on technical grounds, I remembered this First Principle of Law.

My memories of these two First Principles revived when I read a recent judgement of the Supreme Court in the case of Dwarika Prasad Versus Prithvi Raj by Justice Vikramnath and Justice Prasana B Varle.

It said that it is not necessary for an aggrieved party to file a separate application for condonation of delay for applying for setting aside a judgement which passed behind his back.

This reported judgement does not expressly use the words "First Principles of Law" anywhere in the Judgement.

Because...because...because the First Principles are just like diamonds hidden in judgements.

A student of law has to learn to uncover these First Principles of Judgements while reading judgements.

I consider this tip as my most valuable tip to any law student.

My clients are my great mentors. They put food on my table by paying me fee. They put their trust in me. Some of them put their property disputes of crores of rupees in my hand. Some of them who are sentenced to death, put their lives in my hand. Some poor who are languishing in jail put their hopes on me.

Many of my poor prisoners have no relative to follow-up their cases. Sometimes I put my own affidavit to support of their bail application as if I am their only patiokar and request court to dispense with procedure of filing affidavit of prisoner.

Some of them have committed thefts. Some of them have committed rapes. Some of them have committed murders. Some of them are ignorants and have sacrificed a child to deity to remove their sicknesses. Some of them were selling drugs and destroying the youth.

They paid me petty amounts to defend their hopeless appeals.

When I touch their files, I remember a novel titled Resurrection by Leo Tolstoy.

Tolstoy said that the whole machinary of Justice exists only for benefit of those who are running the system and are benefited by this system. He said that the Judges convict a thief but they do not ask why this man was driven to become a thief. The poor men who cannot afford rich lawyers and the poor men who cannot bribe police officers are roasted and fried in the system of Justice.

The rich men bribe out the investigation and escape from the clutches of law.

Last month, a maid servant’s 21 years old son was caught while trying to rape a four year old girl. The girl was saved and 21 year old only son of the maid is sent to jail. The life of maid is ruined. Life of boy is ruined. No one will hold responsible poronographic websites which are pouring day and night sex videos in minds of young boys and girls through their mobile phones.

The law punishes only the act of the accused. The law is not supposed to think about the larger issues which causes crimes in the society.

I think that machinary of law is like a giant clock where wheels keep moving other wheels. Once a person is caught in the cogs of this giant clock, no one can save him. He will be crushed in the cogs of wheels.

And, I am, also just a small cog in the giant wheels of the giant clock of justice.

Date after date date, we keep moving in the wheels along with our clients.

We feel great when we are able to remove some injustice. And we feel sober when we see that we cannot help our clients.

Such is the life of an ordinary lawyer like me.
