Taking someone’s property because they owe you money is a criminal offence that may amount to theft. If someone owes you money and refuses to pay, the proper course of action is to approach the civil courts for legal recourse. The police generally cannot assist with recovering a civil debt because, on its own, it is not a criminal matter.
However, the moment you take that person’s property without their consent even if your intention is simply to recover what you’re owed, you may be committing theft. If the owner reports the matter, you can be arrested and prosecuted.
On the other hand, if you pay someone for goods or services and they never deliver them, the matter may become criminal if it can be proven beyond a reasonable doubt that the seller never intended to deliver the goods or services from the beginning. Depending on the facts, this could amount to theft under false pretences or another fraud-related offence.
Please seek legal advice before taking matters into your own hands. It’s painful to see people getting arrested simply because they were trying to recover money owed to them.
Also remember, returning the property after taking it does not automatically prevent arrest or prosecution. The goods may be recovered, but the criminal case can still proceed depending on the circumstances.
Let’s stay within the law and resolve disputes through the proper legal channels. It will save you unnecessary trouble.
