.@BrendanCarrFCC is weaponizing the “public interest” standard against viewpoints he dislikes. Such jawboning violates the First Amendment, due process, and the rule of law. 75+ civil society groups & free speech experts joined us in this coalition letter 🧵

[Ari Cohn @AriCohn]

The latest in Carr's ongoing effort to exert government control over political information & discourse.

Today, former FCC officials issued a statement (supported by @TechFreedom & @protctdemocracy) calling his latest threat "a direct attack on free and fair elections."

Congress enacted the APA for a reason: to prevent agencies from changing the law without even soliciting public input.

@TechFreedom filed comments challenging the FCC’s expanded interpretation of political ad pricing rules, which would violate the First Amendment & admin law.

Today Senator Blackburn is expected to try ramming KOSA--the Kids Online Safety Act--through the Senate via unanimous consent.

KOSA was an Internet censorship bill in its inception, and in 4 years the only thing its authors have done is try to disguise KOSA's nature, not fix it.

How far can the government go when a president doesn’t like what a broadcaster says?

On a new @TechPolicyPdcst, @TechFreedom’s @AriCohn and @BerinSzoka are joined by @TheFIREorg’s Bob Corn-Revere to unpack the escalating fight between ABC and the FCC.

Justice delayed is justice denied, and nowhere is that more true than when free speech is threatened. If the district court declines to exercise jurisdiction to stop Carr’s abuse of power now, the FCC will run roughshod over the First Amendment for years.

18 FCC veterans of both parties support ABC’s First Amendment lawsuit to stop the FCC from jawboning ABC in retaliation for speech the President doesn’t like. Read the amicus brief we just filed with Protect Democracy ⤵️

Reagan’s FCC Chair, Mark Fowler, put it best: “Never in its history has the agency ever acted so corruptly and unlawfully to intrude on broadcasters’ First Amendment rights.”

The Safer GAMING Act would ban young gamers from even the most harmless communication—not to mention fun and strategic—in online video games, including nicknames in @Pokemon and taunts in @SmashBrosUS. This is lame. It also violates the First Amendment. My analysis in @reason:

What if “harmful content” just means political beliefs someone disagrees with?

On the latest @TechPolicyPdcst, new host @AriCohn sits down with @TaylorLorenz to unpack the free speech and privacy implications of laws like the Kids Online Safety Act (KOSA).

This is what we do best: We defend the First Amendment—and the statutory limits on agencies that check abuse. We build broad, bipartisan coalitions including former FCC leaders, top free speech scholars, and groups across the ideological spectrum committed to free speech.

And last year, when Carr threatened ABC over Jimmy Kimmel's speech, we led a letter joined by 100+ scholars and free speech groups urging Carr to to cease what Sen. Ted Cruz rightly called "mafioso" tactics

I’m glad Disney has shown courage and stepped up.

It is time this administration understands that the Constitution does not bend to political convenience, and that the First Amendment protects news and commentary even when those in power wish it didn’t.
