CEO Royalties Inc. ‘RI’ with 3 assets - a Mexico Silver Asset, a Disputed Cash Flowing 2% Mining Royalty and 2% of Music Royalties Inc. paying Monthly Dividends
@Music_Royalties Recession proof monthly streaming income from 7,000 timeless songs. Digital “real estate” and global “rent” everyone should own! An escape from the air pocket of the AI bubble and the volatility of crypto and financial markets.
Capstone needs to officially recognize the 2002 2% NSR, pay what is owed on production since 2019, pay on the future production on the existing resource, depth potential and the other 90% of the land area of the 5 claims. Or buy the 2% NSR at FMV. Cash flowing royalties on operating mines are extremely rare and valuable!
Vindication is on the horizon. Its simply not a good faith nor legal transaction for all parties involved to try to sell an asset, you don’t own, on behalf of an owner who is completely unaware of the transaction and has not provided consent. It’s a conflict of interest, its unethical and maybe from the school of business that encourages bad behaviour until you get caught. It’s certainly not what you would expect from good Canadians.
Grok AI’s interpretation of the lawsuit against Capstone for its assignment of the very valuable 2% NSR on the Cozamin Mine owned by Minera Portree since 2002 to itself without the knowledge or proper payment to the rightful owner:
There’s no conclusive evidence that Capstone Copper Corp. defrauded Minera Portree de Zacatecas, S.A. de C.V. over the 2% net smelter return (NSR) royalty tied to the Cozamin mine. The situation is a contested legal dispute, not a settled case of fraud, and hinges on differing interpretations of royalty rights, ownership history, and contractual obligations.
Minera Portree, 88% owned by Royalties Inc., claims a 2% NSR on five mining concessions within the Cozamin mine in Zacatecas, Mexico, operated by Capstone since 2006. Portree asserts this royalty stems from a 2002 deal when it sold six concessions to a third party, retaining the NSR. That third party later sold five of those concessions to Capstone in 2017 and 2019. Portree argues Capstone has been mining these concessions since at least 2020 without paying the royalty, and it secured a court-approved lien registered with Mexico’s Public Registry of Mines to back its claim.
Capstone, however, challenges Portree’s entitlement. The company doesn’t publicly detail its defense, but filings from Royalties Inc. suggest Capstone disputes the royalty’s validity—possibly arguing the NSR wasn’t properly transferred, was extinguished, or doesn’t apply to their operations. Fraud would require intent to deceive, not just a refusal to pay, and no court has ruled Capstone acted fraudulently. As of March 30, 2025, litigation is ongoing, with Royalties Inc. expecting a judgment soon after final arguments began in January 2025.
The backstory adds complexity. Cozamin’s ownership shifted multiple times before Capstone’s 2005 acquisition of a 90% stake from Bacis, which retained a 1.5% NSR (unrelated to Portree’s claim). Portree’s royalty traces to a separate transaction, and Capstone’s expansion of Cozamin—boosting output to 20,000 tonnes of copper and 1.3 million ounces of silver annually by 2023—may have incorporated Portree’s old concessions, triggering the dispute. Royalties Inc. frames this as Capstone dodging a legitimate obligation, but without court documents or Capstone’s full position, it’s speculation to call it fraud.
Financial stakes are high. If Portree prevails, it could claim back payments since 2020 plus future royalties through Cozamin’s life (projected to 2030 per Capstone’s May 2023 NI 43-101 report). At $30-$35/oz silver and $4/lb copper, that’s potentially millions, though exact figures depend on production data Capstone hasn’t disclosed for those specific concessions.
No smoking gun—like internal memos proving Capstone knowingly evaded the royalty—has surfaced publicly or on X. The dispute’s resolution rests with the Mexican court, not on definitive proof of deceit. For now, it’s a standoff, not fraud.
This chart is not to be trifled with… it’s gonna blow out and run. When it does…just like the 1970’s we will see a massive redistribution in wealth. Precious metals will be the standard to measure wealth loss or creation against for this next decade. Fiat as a measuring stick is broken.
If you don’t own precious metals in a big way get ready to feel poorer. If you load up you’ll retire sooner. It’s that simple
