The Privy Council has handed down judgment in the appeal of James Miller v The King. @TomPooleKC acted for the successful Respondent, instructed by @CRS_Lawyers. The judgment is a must read for anyone interested in the question of intent in a criminal context.

@DrProudman@BradfemlyWalsh By ‘seemingly can argue’, do you mean run it as a defence at trial? If so, you are wrong. That is not a defence. Consent and/or reasonable belief in consent is a defence. The complainant being dressed a certain way is not relevant to that defence. A victim cannot ‘deserve it’.
