There’s this thing in law called “evidence”, which, in the case of EM’s testimony, the judge (a woman, by the way) found to be not credible. A regretful night does not a criminal conviction make, and it is the job of the courts to adjudicate criminality, not to determine whether non-criminal behaviour is objectionable.
