【記事には書いてない】んだけど。これ現実的に最高裁の判断通りに申告を行うのは限りなく不可能です。

言い換えると「日本人は海外投資をするな」と言う判決が下されたと言うのに現実的には限りなく等しい。

現代の資産運用やビジネス活動ってのは。世界中の企業や商品に投資する行為なんで為替換金なんてもんは日常的に行われている。と言うかやらなきゃ無理なのよ。

そもそもオルカン含めて「ファンドの内部」では当たり前の行為。

それを日本に住む日本人が。個人や法人でやると「外貨を換金するたびに税金で罰せられる」と言う無茶苦茶な話なの。

（注）日本企業が（例えば商社が）海外拠点を経由して三国間以上の貿易取引をした時に「外貨→外貨」で取引する事なんてザラにある。そのたびに取引に使われる外貨を取引の瞬間の為替レートで日本円に換算し直して。その瞬間のレートで為替差益が出ていたら。その差益に対していちいち税金を払えと言われたわけ。これじゃもはや為替変動リスクがデカすぎて見積もりに躊躇してしまうだけでなく。納税のための複雑な書類作成まで同時にこなさなければならなくなって。面倒くさすぎて最初からビジネスする気すらなくしてしまう。

◉それ故にどうなるか？というと…

既に多くの海外金融機関が「日本居住者（日本に住む日本人）」との取引を嫌がって口座開設を断る（或いは解約する）ようになっている。

だって海外の銀行にとって。日本に住む日本人なんてのは。数ある顧客の中のひとつに過ぎない。

わざわざ日本の【超複雑な雑所得の計算ルール】に合わせ。日本に住む日本人顧客のひとりひとりに対してだけ。瞬間瞬間の為替レートを使用した日本円換算での年間取引における為替損益報告書なんて作ってらんない。

◉こんなの誰にでも解るでしょ？

それだけでなく海外の銀行側から見たら以下となる。

（１）日本に住む日本人が
（２）我々の金融サービスを使用することで
（３）世界にも稀な日本独特の追い剥ぎのような税法によって
（４）脱税モドキの指摘を受け
（５）銀行名が公表されるなら
（６）可哀想だけど日本に住む日本人はもう見捨てよう

というリスク回避が世界的に進んでしまう。そしてそうなってる。

◉世界から絶対に見捨てられていく

実は【これも記事には書いてない】んだけど…

この最高裁判決の裏側で【林道晴裁判長ら３人の裁判官が補足意見】を残してる。大筋で次のような内容で政府と財務省・国税庁に対する苦言である。

◉今回の判決はね？現行の​日本の法律を【そのまま解釈せざるを得なかった】んだわ。だからこの判決になったんだよ。

◉現行の日本の税法では。外貨を換算するたびに【その都度課税】をしなけりゃならないように書かれてるんだから仕方がなかったの。

◉だけどね？考えても見ろよ。現在は国際取引がこれだけ盛んになった時代なんだから。我々だってこの判決で良いはず無いとは思ってんだ。

◉だから国は。もっとシンプルでちゃんとした。世界標準の税法に作り変えなさい。

​つまり最高裁側も「今のままだと実務が猛烈に面倒だし。企業も投資家も混乱するし。マイナス面しか無いよね」という問題意識をはっきりと持ってるの。

◉要するに。財務省・国税庁が政治家に作らせた税法が無茶なんだって言う苦言も最高裁は同時に述べてんだよ。

Insane.

They rushed it through with mostly Democrat votes. The plan has 222 votes. It needs 270 to actually start working. Once it does, your vote in Virginia doesn’t matter anymore.
