Without a defined standard, this risks being applied inconsistently or used to exclude smaller parties’ representatives from executive/committee roles, especially since no similar bar exists on being elected in the first place. Worth flagging if there’s any indication of how COGTA plans to define it before the Bill’s wording is finalised.
On the Executive Committees point, it’s useful to know it’s the DA specifically, and that legal advice may have played a role rather than pure politics. Do you know if that legal opinion is public, or if it’s similar in nature to the State Law Adviser’s opinion on vote thresholds?
And agreed on mandatory coalition agreements. Hard to see how you’d draft an enforceable version without running into freedom-of-association or party-autonomy issues. If nobody’s put forward a workable model, that may be the real reason it keeps disappearing rather than active political blocking.
