He didn’t just disagree. He EXPOSED the entire delay game.
The plaintiff states CANNOT scream “timing!” when THEY and activist lower courts CAUSED the delay. 😡
“The plaintiff States cannot claim the TIMING of the rule tilts the equities in their favor when they, and courts hearing their claims, are RESPONSIBLE for so much of the delay.”
The government got hit with MONTHS of premature lawsuits + injunctions this Court later said were likely issued WITHOUT JURISDICTION… then had to wait ANOTHER FULL MONTH for the Court to even say so. ⏳💣
Nationwide injunction from groups that likely LACK STANDING. District courts blocking rulemaking for months. Classic lawfare playbook. 🎭
