1. The republic is rampant with criminal prosecutions primarily instigated by crony capitalists to extort commercial outcomes.

Often, Constitutional and JR courts are reluctant to take a peak at the evidence, telling you to just go on trial.... yet the sham criminal trial itself is the prize that the crony capitalists want in order to tie you down and clear the way for them to pursue their crony commercial interests, unhindered. The mere fact that you are on trial eliminates a lot of commercial impediments for the crony capitalists.
3. And in the case of Benson Ndeta, the fact that you are undergoing criminal proceedings obviously affects your ability to compete for Bamburi cement?
4. When we weaponize the criminal justice system on commercial matters obviously its going to increase our riskiness and cost of capital in the global markets. We must first start by cleaning our act at home before we go wailing about unfair cost of capital in the global markets.
5. Benson Ndeta was lucky that a suit in the commercial division conclusively brought exculpatory evidence that he would have had to take 5 years in criminal trial to be vindicated. And once the crony capitalists put you on trial in criminal court, they will start delay tactics to keep you there.
