Trump’s EPA just decided that if a power plant exists solely to supply a data center, it is exempt from the Acid Rain Program. That means it no longer has to comply with the program’s limits on sulfur dioxide emissions, even though the pollution is exactly the same.

Congress created the Acid Rain Program in 1990 because sulfur dioxide and nitrogen oxides don’t stay where they’re emitted.

They travel downwind, fall as acid rain, damage lakes and forests, and worsen asthma in communities that may be hundreds of miles away.

Nothing about that science changes because the electricity is sold to one customer instead of many.

EPA is trying to create this exemption while avoiding Congress. But agencies cannot rewrite statutes by memo. If Congress intended to exempt privately dedicated power plants from the Acid Rain Program, we would have written legislation to do so. We most certainly have not.

EPA is attempting to narrow a law Congress enacted without Congress’s approval. Courts should reject it, and Congress should make clear that clean air protections apply based on pollution, not on who buys the electricity.

Our kids deserve clean air more than data centers deserve a special loophole.

Wind is over 1.3 TW. Together, they make up 4.3 TW.

For comparison, U.S. average power demand is 0.47 TW, so W+S can now meet a peak of 9x U.S. average power demand or, over a year, 2x U.S. electric energy demand.
