I see your confusion, for that I'll indulge you a moment longer.

You think this goes to a court inside the occupying power's jurisdiction, which itself defers by UK statute to the UK Supreme Court. That misunderstands the issue, and it's gravity.

A body can't lawfully judge the validity of its own creation. Courts that derive their existence from the state created by the 1707 Union can't by definition sit in judgment on the Union's legality. That's why the forum is international law, where questions of state formation and sovereignty are justiciable.

Domestic courts adjudicate within a system; international law adjudicates the system itself.

Did you miss the post earlier where I said:
