• Well, before now, crypto trading was NOT illegal in Nigeria - Federal High Court declared in Central Bank of Nigeria v. Rise Vest Technologies Ltd & Ors Suit No: FHC/ABJ/CS/822/2021 delivered on October 18, 2021.

• Meanwhile, before the coming into effect of the Investment & Securities Act, 2025 - the Securities & Exchange Commission in 2022 had issued “New Rules on Issuance, Offering Platforms and Custody of Digital Assets” which recognized cryptocurrencies as digital assets and subjected it to regulation.

• Besides, in 2023, the CBN had also issued “Guidelines on Operations of Bank Accounts for Assets Service Providers” to take care of VASPs engaging in crypto transactions.

• In consequence of the above therefore, the new legal regime {Investment & Securities Act, 2025} just simply provided more clarity & legal backing for robust regulation of digital assets. Thus, the Law now expects that you pass through some regulatory processes with SEC to be enabled to issue crypto as security, invite investors, trade crypto assets amongst others.
