ผมขอยืนยันอีกคน ว่านายกฯ มีอำนาจหยุดการซื้อไฟที่แพงเกินจริงครั้งนี้ โดยขออธิบายยาวหน่อยนะครับ

1. พวกเราในฐานะเอกชนคนทั่วไป เราจะทำอะไรก็ได้ เท่าที่ไม่ขัดกับกฎหมาย

2. แต่หน่วยงานรัฐจะตรงข้ามกับพวกเรา คือจะทำได้เฉพาะเท่าที่กฎหมายให้อำนาจไว้เท่านั้น ถ้ากฎหมายไม่ได้ให้อำนาจก็จะทำไม่ได้

3. กกพ. ก็เป็นหน่วยงานรัฐ จึงทำได้เท่าที่กฎหมายให้อำนาจเช่นกัน ซึ่งกฎหมายให้อำนาจว่า "กำกับดูแลการประกอบกิจการพลังงานเพื่อให้เป็นไปตามวัตถุประสงค์ของพระราชบัญญัตินี้ภายใต้กรอบนโยบายของรัฐ"

4. ดังนั้น กกพ. จะทำอะไรที่ขัดกับนโยบายของรัฐไม่ได้ เพราะจะเป็นการกระทำนอกเหนืออำนาจตามกฎหมาย

5. ผู้ที่กำหนดนโยบายให้ กกพ. ทำตาม ก็คือ กพช. ที่มีนายกฯเป็นประธาน และมีรัฐมนตรีจากกระทรวงต่างๆเป็นกรรมการส่วนใหญ่นั่นเอง

6. กกพ. อยู่ๆจะไปซื้อไฟฟ้าเองไม่ได้ ต้องมีนโยบายจาก กพช. มาก่อน แล้ว กกพ. ถึงจะไปดำเนินการตามที่ กพช. กำหนดได้ แสดงให้เห็นถึงความสัมพันธ์ของ กพช. และ กกพ. เป็นอย่างดี คือ กพช.เป็นกองไฟ และ กกพ.เป็นควัน ควันจะไม่เกิดขึ้นเองถ้าไม่มีกองไฟ

7. ดังนั้นในทางกลับกัน ถ้า กพช. เปลี่ยนหรือถอนนโยบายที่เคยกำหนดให้ กกพ. ไปซื้อไฟฟ้า กกพ. ก็จะไม่สามารถซื้อไฟฟ้าได้แล้ว เพราะฐานแห่งอำนาจที่เคยใช้ในการซื้อไฟฟ้าหายไปแล้ว เปรียบเสมือนพอกองไฟดับควันก็จะหายไปด้วย

8. นายกฯในฐานะประธาน กพช. และหัวหน้าของรัฐมนตรีทั้งหลาย จึงเป็นคนเดียวในตอนนี้ที่หยุด กกพ. ได้

9. เพราะ กกพ. ก็ไม่กล้าหยุดตัวเอง เพราะไม่งั้นจะขัดกับนโยบายที่ กพช. เคยกำหนดไว้ให้ซื้อไฟก่อนหน้านี้

เหลือเวลาอีก 7 วัน มาช่วยกันส่งเสียงให้นายกหยุดเรื่องนี้กันครับ
