According to @Variety—more pointedly, @blakelively's publicist #LeslieSloane—the case was framed as something of national importance, with arguments that its outcome could influence how victims of sexual harassment come forward. That’s a compelling narrative. The court, however, saw it differently.

Judge Liman dismissed all of @blakelively’s federal claims, including those under Title VII for sexual harassment and retaliation, along with her California Labor Code claims. The state law claims—sexual harassment, defamation, false light, and conspiracy—were also dismissed.

In practical terms, that means both @blakelively's federal and state sexual harassment claims failed to survive the Wayfarer parties’ motions for summary judgment and judgment on the pleadings. In breaking down the allegations, the court was methodical:

— A pre-employment comment about circumcision... penis talk? Not actionable—wrong time, wrong context;
— Discussions about more explicit scenes? Considered part of developing a film centered on adult themes, not evidence of discrimination;
— Comments about weight and physical condition? Interpreted as role-related, especially given @blakelively’s own stated fitness goals;
— On-set physical interactions during a dance scene? Seen as within the bounds of performance and improvisation;
— “Sexy” and “pretty hot” remarks? Acknowledged as inappropriate, but not severe or pervasive enough to meet the legal threshold...

Not quite the landmark moment it was billed as 🤷🤷

@drugproblem Blake dropped her case because it came out that she and Ryan asked Sony to destroy evidence in the form of dailies something she said in her depositions that she didn't do so that was perjury. I understand why she wanted to settle trial would have been a disaster for her.
