7 CFR 271.2 defines trafficking as exchanging food stamp benefits for cash or anything “other than eligible food.” Indiana’s SNAP waiver and SEA 1 redefined “eligible food” to exclude soda and candy. So, as an Indiana resident, buying soda or candy with EBT is exchanging food stamps for something other than eligible food — it’s trafficking. 7 USC 2024 makes trafficking a felony if the value is greater than $100.

Hoosiers taxpayers should not subsidize poisoning our low income families. The “Supplemental Nutrition Assistance Program (SNAP)” was never intended to be anything other than an affordable way to access additional healthy food for people who truly need it.
