Justice Felix Frankfurter, Dissenting, Henslee v. Union Planters National Bank & Trust Co., 335 U.S. 600, 1949.
Common law grand juries were formed in Georgia following Obama’s citizenship. They formed indictments and presented them to law enforcement and District Attorneys, and Attorneys General. They all refused to act, exposing the weakness of Common Law grand juries: if you have no enforcement your indictments carry no weight.
You could indict every DA and AG but without enforcement they carry no weight, Constitutional or not.
@GregNotSure@jtalexander The state of Tennessee is under investigation right now for charging 2500 people with DUI whose blood showed they were completely sober. Every time I check in on the story, the number goes up.
The state cannot set up checkpoints that are unconstitutional where they shake down every American for DUI and then expect a sympathetic jury.
This is a statement of simple human behavior. I make no characterization about right or wrong. The state is its own worst enemy and Americans generally have no compassion for it, and I will say that is right.
