We have posted about the Avelino precedent several times. We have learned, corrected, and updated. Now here is the final word.
The Avelino case (1949) allowed 12 senators to act โ but only because the session was already in progress. Senator Avelino walked out mid-session. The remaining 12 continued the same session. That is the key: continuity.
Now look at 2026. The Senate adjourned on May 26. When they reconvened on June 1, 2, and 3, it was a new session. The Constitution requires 13 senators (a majority of 24) to begin a new session.
The Gatchalian bloc started a new session with only 12 senators. Then they declared the Senate President position vacant and elected an acting president. They did not continue a stalled session. They began a fresh session without a legal quorum.
Therefore, Avelino does not apply. Their action is not a precedent โ it is a violation. The coup was built on a misreading of a 76-year-old case.
We are not lawyers. We are ordinary citizens from Davao. But we can read the facts. And the facts say: the rules were broken from the very start.
