Why don't people read the Constitution? "Mt. Kenya" is not a constitutional or administrative unit. It is a cultural and historical identity a community of people with a shared heritage, language, and sense of belonging. You cannot partition an identity through a referendum.

The argument that "Mt. Kenya West" has never supported "Mt. Kenya East" also falls apart when you look at history. During President Mwai Kibaki's administration, several of the most influential Cabinet positions were held by leaders from what is today referred to as Mt. Kenya East, including David Mwiraria, Kiraitu Murungi, Njeru Ndwiga, and Martha Karua. Their appointments did not trigger claims that one side of Mt. Kenya was dominating the other.

Yesterday's judgment raises a serious question of prosecutorial consistency. If the doctrines of common intention, joint enterprise, aiding and abetting, or principal liability are to be invoked, then it is difficult to reconcile the exclusion of Deputy Inspector General Eliud Lagat from the list of accused persons in the Albert Ojwang matter, particularly where it is alleged that his complaint set in motion the chain of events that culminated in Ojwang's death.

If the prosecution's theory is that criminal liability extends beyond the immediate perpetrators to those who initiated, directed, procured, or substantially contributed to the commission of the offence, then the same legal standard must be applied consistently. The Constitution guarantees equal protection and equal benefit of the law; selective prosecution offends both the appearance and the administration of justice.

He was there when the complaint was made,

there when every movement was reported.

He was there when Albert was taken,
there when power became a weapon,
there when a young man was dragged far from home,
there when fear was meant to serve as an example.

Then Albert died.

Suddenly, the chain broke.
The briefings vanished.
The orders became whispers.
The senior man became a stranger.

Junior officers were left holding the blood,
while the powerful washed their hands
and called it exoneration.

But how do you clear the man
who stood at every door
until death entered the room?

How do you erase his shadow
from a story where it followed Albert
from the complaint
to the arrest
to the final breath?

They may clear his name on paper,
but Kenyans can still read the trail.

You cannot be present at every step,
then disappear only when the body appears.

The officers who arrested Albert Ojwang’ were briefing Eliud Lagat on everything, including their movements, yet Kenyans are now being asked to believe that the briefings suddenly stopped just before Albert was killed and that Lagat somehow became a complete stranger to the operation.

That story does not add up.

You cannot receive updates throughout an operation, follow the movements of the officers involved and then conveniently disappear from the chain of communication at the exact moment the operation turns deadly.

Kenyans are not stupid, and any attempt to isolate junior officers while Eliud Lagat is treated as though he knew nothing must be rejected.

Eliud Lagat, the Deputy Inspector General of Police, should be in jail together with OCS Samson Talaam! Lagat sent officers to abduct Ojwang from Homa Bay County and ordered his murder. He was the complainer and the man who stood to benefit from Albert Ojwang's death.

I am shocked by the sudden honesty from the State over the death of Albert Ojwang, including the recovery of CCTV footage and the speed at which some details are now being released to the public.

Whenever the State becomes this open in a case involving powerful people, I immediately ask myself whether they are preparing to sacrifice a small fish so that the person who gave the orders remains protected.

The Star reported that Albert was at one point removed from Central Police Station and taken to Karura, where he was said to have met a senior police official before being tortured, collapsing and causing panic among those involved.

This sudden honesty now begins to connect the dots, because the State may be showing Kenyans the final part of the story while carefully keeping attention away from who ordered Albert’s removal, who was waiting in Karura and why he was taken there.

When the State shows you something and tells you something, do not only look at what they have presented, always ask what they are hiding, who they are preparing to blame and which bigger person they are trying to protect.
