Here's another lawsuit where a brand is being sued for using music available in Instagram's general music library.
People ask whether it's just the big record labels going after the big brands. It's not.
Maison Baby made a post that included the song "You Stole My Heart" by My Sun and Stars. The post got 15 likes and 1 comment.
And while the song is available in the general IG library, it's not in the commercial sounds library, and so IG users do not have a license to use it in commercial content.
If you post on your brand's page (or an influencer posts as part of a campaign), that's commercial content, even if it's organic.
And so you risk copyright infringement litigation if you do that.
