As the empire falls it retreats to its most basic motivations: anti-black racism. This is what drives it, as it sits on an unresolved genocide of native Americans, trans-Atlantic slavery, plantations and Jim Crow. Crimes it never atoned for! So that in the end, there was truly no consequences for being racist!

Imagine if people marched, with their faces hidden, elevating the Nazi flag in Washington. What do you think would happen? There would be consequences. But it is OKAY to demand a white supremacist universe - a world without people of colour!

This is why there is, correctly, endless compensation for the holocaust. Yet, nothing for genocides against native populations anywhere in the world. Nothing for slavery, colonial, apartheid and Jim Crow crimes!

And because one day we accepted that racism doesn’t have to meet consequences, doesn’t have to pay the cost for its destruction, it always feels the need to resume its status in organising social and economic lives of communities!

Undocumented immigrants are fully protected by South African labour law and have the absolute right to refer disputes to the Commission for Conciliation, Mediation and Arbitration (CCMA). 

The South African legal framework establishes this protection through specific constitutional principles, landmark case law, and statutory definitions: 

The Constitutional and Statutory Framework

The Constitution: Section 23 of the South African Constitution states that "everyone" has the right to fair labour practices. The word "everyone" is interpreted literally and is not restricted to South African citizens or legally documented residents. 

Definition of an Employee: Section 213 of the Labour Relations Act (LRA) defines an employee based on the actual working relationship rather than the validity of an underlying contract.

A person who assists in conducting a business and receives remuneration is an employee by law. 

Key Precedents and Court Rulings

Discovery Health Limited v CCMA (2008): The Labour Court explicitly ruled that a contract of employment is not void simply because the worker is an undocumented foreign national.

The court affirmed that undocumented workers are "employees" under the LRA and are protected from unfair dismissal. 

Onus on the Employer: Under the Immigration Act, the statutory prohibition is aimed directly at the employer (who is legally forbidden from hiring unauthorized workers), not at the worker. Therefore, an employer cannot use their own statutory violation (hiring an undocumented worker) as a defense to escape labour law obligations or to dismiss someone arbitrarily. 

What This Means in Practice

No Instant Dismissals: An employer cannot summarily fire a worker just because their work permit has expired or is non-existent. 

Required Legal Processes: To terminate the relationship legally based on a lack of permits, the employer must follow a fair incapacity process. 

Dual Legal Consequences: If an employer violates immigration laws, they face criminal prosecution, steep fines, or imprisonment by the Department of Home Affairs. Simultaneously, they remain fully bound by the CCMA to pay out statutory obligations, back pay, or unfair dismissal compensation to the worker.

She incites violence by using indirect rhetoric that mobilises anger amongst her illiterate, tribalist and xenophobic followers by blaming foreign nationals for all sorts of societal problems.

She thinks that by manufacturing plausible deniability while still indirectly mobilising violent action will excuse her from the legal repercussions of her stupidity.

Her lawyer husband who was masquerading on TV as March and March legal advisor is misleading her.

She is going to end up in prison.

She has already led a march that descended into public violence in East London.

Most tragically is how they defer their entire thinking on geopolitics to Euro-America: a complete zombification!

Sad story! But also a culture shock if you think about it: a white dominated party under complete intellectual tutelage by western, equally ignorant white masters. Tragedy at its best! No original, autonomous or even critical thinking… ZERO!

When you hear them speak, you really wonder if these people know they are in Africa, global south and post-colonial country! None of these categories, which are grounded in history and reality, inform any of their world view.

New trade agreement between South Africa and China

News that South Africa is in the process of concluding a trade agreement with China should be welcomed with caution. Parks Tau, Minister of Trade, Industry and Competition, is reportedly on his way to China for the final round of negotiations.

South Africa is an industrialised country par excellence with growth driven by exports and therefore trade. Our international trade is already quite diversified and the more access South African producers can gain to markets where there are currently all sorts of barriers, the better.

However, China's motive for trade agreements must always be questioned. After all, China achieved a trade surplus of R1.2 trillion with the rest of the world last year.

South Africa's largest single trade deficit is with China. Although complete data for 2025 is not yet known, in November 2025 we had a trade deficit of R19.4 billion with China for a single month. We exported goods worth R19.1 billion to China and imported goods worth R38.5 billion from China. By all estimates, we are likely to have a deficit of almost R250 billion rand in trade with China in 2025.

The Chinese have easy access to the South African market and are increasingly dumping products subsidized by the Chinese government into our market. China mainly buys unprocessed raw materials from SA. The trade relationship between South Africa and China is completely unequal and any trade agreement must at least partially correct this.

The problem is present across Africa. In 2025 trade between China and Africa reached $348 billion, an increase of 17.7% from 2024. As in the previous year, this growth was largely driven by rising Chinese exports, which amounted to $225 billion, compared to $123 billion in imports from the African continent. In fact China’s imports of goods from Africa are not increasing much, while imports from China to African countries are increasing by between 15% and 20% year on year.

China is constantly erecting new barriers to some of its best trading partners. Recent higher tariffs on red meat are a good example. While US tariffs are rightly condemned, there is often silence about how China manipulates and undermines trade agreements with countries to promote local production and continuously stimulate exports.

How China abuses and manipulates bilateral trade agreements

China exploits bilateral trade relations through various unfair practices that perpetuate imbalances and hinder South Africa’s economic development. These include:

1. Dumping cheap goods into the South African market.
China floods South Africa with subsidized, low-cost manufactured products such as clothing, electronics and consumer goods, undermining local producers and leading to job losses in local industries.

2. Barriers and obstacles to South African exports.
China imposes tariffs, non-tariff barriers (e.g. strict regulations, phytosanitary standards and bureaucratic hurdles) and competitive disadvantages such as distance and market access restrictions, which limit South Africa’s ability to export value-added or agricultural products.

3. Structural trade imbalance favouring raw material extraction.
South Africa mainly exports unprocessed commodities to China while importing high-value manufactured items, creating dependency, minimal job creation in South Africa and a sustained cash outflow.

4. Chinese subsidies and competitive advantages.
Government subsidies in China enable lower production costs for processed goods, making it uneconomic for South Africa to process its own minerals domestically (manganese processing is a good example).

We should therefore hope that the South African government will push for a correction on all these points in its negotiations with China. Although it is often said that China is South Africa's largest trading partner, this is simply due to our enormous imports from China. So, while our total trade with China is much larger than with the US, our exports to both countries are almost the same. The enormous trade deficit with China (while we realise trade surpluses with the US, Europe and Britain) is unacceptable and must be corrected in any new trade agreement.
