@sdcilaw@OJEN_ROEJ@ProvostLaw 2/2 -are permitted and some not will never be a viable solution, as anyone evicted from one will simply move on to the next. By evicting the homeless, the city is preventing all possible future occurrences of nuisance, violence, or public disruption. @OJEN_ROEJ#OJENROEJSP22
It is fact that these encampments have been dangerous to the public. S. 2 of the Charter guarantees one's right to peaceful assembly. Illicit activities occurring in encampments lead to hostile environments, which is not considered peaceful. @OJEN_ROEJ#OJENROEJSP22@ProvostLaw
@sdcilaw@OJEN_ROEJ@ProvostLaw 1/2 There are inherent risks when allowing people to reside in outdoor spaces. There is no denying that there is a stigma associated with the homeless, however there is evidence of violence, drug use, and death. A system where some encampments @OJEN_ROEJ#OJENROEJSP22@ProvostLaw
@mar1saaaaa Who can be blamed for this violence? This sounds like an internal issue short of the lack of mental health support on behalf of the shelter, but being blamed on the city. @OJEN_ROEJ#OJENROEJSP22@ProvostLaw
@sebm2431 @ProvostLaw These are BASIC rights guaranteed by the Charter which are satisfied. At this point, it is no longer about violation of rights but a lack of luxury. I agree there needs to be more resources to combat overcrowding. @OJEN_ROEJ#OJENROEJSP22@ProvostLaw
Homeless shelters are operated by entities other than the city (Poff v. City of Hamilton). They are not telling homeless people where to live, rather maintaining law and order to preserve a safe and functional society. @OJEN_ROEJ#OJENROEJSP22@ProvostLaw
@Vampire_Apple02@OJEN_ROEJ It should not matter the park size. In both cases it is more than possible that these encampments provide a public nuisance- regardless of the situation. The law here should be objective. @OJEN_ROEJ#OJENROEJSP22@ProvostLaw
@KaileezJ @OJEN_ROEJ (2/2) Don't forget these bylaws apply to other members of the public as well. The same eviction issue may prevail if wealthy individuals were to take over a park and cause a nuisance/ impede on public safety. @OJEN_ROEJ#OJENROEJSP22@ProvostLaw
@KaileezJ @OJEN_ROEJ (1/2) Of course homeless individuals are members of the public- why else would the bylaws apply? I do not believe there is active discrimination here. If I'm not mistaken, you are referring to discrimination of economic status. @OJEN_ROEJ#OJENROEJSP22@ProvostLaw
