3 of the biggest academic publishers in the world sued a photocopy shop.

The shop charged 50 paise a page. It sat inside a university campus in Delhi and had 1 owner.

The case ran for 4 years. The shop won, and the law changed.

His name is Dharampal Singh.

He set up Rameshwari Photocopy Service in 1998, in a small licensed space inside the Delhi School of Economics at the University of Delhi.

The work was simple. Professors would prepare a reading list. For a course like Agrarian Sociology, that might mean 33 different readings, scattered across 33 different books, most of which cost more than a student's monthly budget and some of which the library had 1 copy of.

Singh photocopied the relevant chapters, bound them together, and sold the bundle. It was called a course pack. The price was 50 paise per page.

That is less than 1 American cent.

He explained it in 1 sentence. If a student needs 33 readings for a course, he said, it could take months to collect them from different books. I make life easier for students by giving them all the material in 1 pack.

In August 2012, Oxford University Press, Cambridge University Press and Taylor and Francis filed suit in the Delhi High Court against the shop and against the University of Delhi. They wanted a permanent injunction.

By the end of 2012 the court had granted a temporary one. A commissioner was sent to the shop without warning, made an inventory, and seized copies.

Then something unusual happened.

Students organised. 2 groups, one of students and one for educational access, formally applied to join the case as defendants, on the side of the photocopy shop. The court allowed it.

In March 2013, 309 authors and academics from around the world wrote an open letter to the publishers asking them to withdraw the case.

33 of those 309 had written the very books whose copyright was allegedly being infringed.

The authors were siding with the shop copying their books.

On 16th September 2016, Justice Rajiv Sahai Endlaw dismissed the suit entirely. He wrote that copyright in literary works is not an inevitable, divine or natural right conferring absolute ownership on authors.

The publishers appealed. On 9th December 2016, a 2 judge bench of the Delhi High Court delivered the final ruling.

It held that reproducing copyrighted material for the purpose of educational instruction is not infringement under Indian law, and that no licence or permission from the publisher is required for a course pack, however much of the book is copied, as long as it is justified by teaching.

Then the publishers withdrew from the case entirely.

The shop is still there.

The next time you are told that intellectual property law always favours whoever has the most expensive lawyers, remember that 3 of the largest publishers on Earth spent 4 years trying to shut down a photocopy shop charging half a rupee a page.

And lost.

मयंक चला गया, अभी कई जाने वाले हैं !
आप यह पढ़ लें बस, इतना अहसान बहुत होगा !

मयंक सक्सेना के दिल मे दर्द हुआ था, चेकअप कराने के लिए अस्पताल में गया था। दिल वहीं बैठ गया और मयंक की रूह वहां से रुखसत हो गई ! मयंक ने X पर जो पोस्ट पिन की हुई है। उसमें मयंक ने अपने संसाधनों से चुनावी कवरेज़ की दुश्वारियों क�� वर्णन किया था। मयंक का जाना खराब लगता है ! यह बुरा है ! दुःखद है और आक्रोश पैदा करता है !

अभी कुछ और भी मयंक लाइन में लगे हैं, वो भी चले जाएंगे ! हो सकता है मैं भी चला जाऊं, शायद 2 बेटियों का पिता हूँ, इ��लिए अल्लाह ने रोका हुआ है। पिछले कुछ सालों से पत्रकार सबसे उत्पीड़ित जाति है। सब तनाव में है। किसी की नौकरी चली गई ! किसी पर मुक़दमा हो गया ! कोई खून का घूट पीकर गुलामी कर रहा है। किसी ने चाट की दुकान खोल ली है। हजारों की बच्चों के स्कूल की फीस नही जा पा रही ! शहरों में घर का किराया नही जा रहा ! गांव में मम्मी को पैसा नही जा रहा ! शादियों में शिरकत करनी बंद कर दी है, पत्नी रोज झगड़ा करती है , फ्रीलांस जर��नलिज्म अपने अंत की और है। कुछ रात के अंधेरे में ओला -उबर चलाते हैं। इन्हें नेता रोज़ अपमानित करते हैं ! आज हजारों पत्रकार अवसाद में हैं। यह वैकल्पिक मीडिया के पत्रकार है। जिनमे क़ाबलियत तो है मगर देश की मैनस्ट्रीम मीडिया ��े उनके लिए दरवाज़े बंद कर दिए हैं, या फिर उन्होंने सम्मानपूर्वक किनारा कर लिया है।

आज इंडिया गठबंधन जिन 235 सीटों पर रीझ रहा है, इनमे इन अपने संसाधनों पर संघर्ष करने वाले पत्रकारों का सबसे महत्वपूर्ण योगदान हैं। यह वैचारिक चुनाव था और इन मुख्य धारा से 'निकाले' असली पत्रकारों ने सच और हक़ की आवाज को दबने नही दिया ! सच के विचार को जिंदा रखता ! टीवी मीडिया ने षड्यंत्र कर लिया था ! राहुल की यात्रा किस���े दिखाई ! राहुल की बात किसने उठाई ! अखिलेश के पी डी ए पर किसने बात की ! मयंक जैसे स्वयंभु संस्थानों ने ! जिन्हें किसी ने एक रुपया नही दिया ! जो खुद से लड़ रहे थे ! अपने अपमान का बदला लेने के लिए, खुद की हताशा से और अपने बच्चों के बेहतर भविष्य की चाहत में !

आज इन पत्रकारों को इंडिया गठबंधन का चाटुकार कहने वाले क्या जाने ! कि ��ीडिया की आज़ादी छिन जाने के बाद मयंक सक्सेना जैसे पत्रकारों ने आखिर झेला क्या है, जो उनका दिल इतना कमज़ोर हो चुका है ! सच कह रहा हूँ ! मेरा दिल भी कई बार बैठ चुका है ! मगर कोई ताक़त मुझे बचा लेती है ! ज़रा सा नाम बन जाए ! तो सीनियर षड्यंत्र करने लगते हैं ! किस -किस से लड़े आज के 'मयंक'। स्टोरी अप्रूवल के लिए युद्ध लड़ने पड़ते हैं !-

मयंक जैसे पत्रकार जनता की सही बात खोज कर लाते है तो विपक्ष को मुद्दा मिलत��� है। इस चुनाव में खुद मैंने कितने संघर्ष करके रिपोर्टिंग की है, मगर बयां नही कर सकता ! दोस्तों के घर रात गुजारी ! पैदल ,ऑटो, बाइक से यात्रा की, बस और ट्रेन की गर्मी झेली ! चलिए यह सब भी ठीक है ! कलेजा तो तब छिलता था, जब हमसे बहुत कम क़ाबिल मैनस्ट्रीम वाले पत्रकार इनोवा में घूम रहे हैं ! महंगे होटल में रुक रहे हैं! और तो और हेलिक��प्टर में उड़ रहे हैं ! और वो हमारी खिल्ली भी उड़ा रहे हैं।

मयंक की मौत ने हिला दिया है ! अब तक स्वतंत्र पत्रकारों की इस दशा के लिए मैं सरकार और उसकी नीतियों को जिम्मेदार मानता था। मगर अब मैं इस तनाव और अवसाद का कारण कांग्रेस और उनके सहयोगी दल को मानूंगा ! क्योंकि जब मयंक जनता के दिल की बात खोज कर लाया तो राजनीतिक लाभ किसे मिला,मुद्दे किसके हाथ आए ! आत्मविश्वास किसका जनित हुआ !- ख़तरा उठाया किसने ! ��म दिखाया किसने ! जगाया किसने ! तो मुसीबत में मदद करेगा कौन !!

सुन लो आज लोकतंत्र के तमाम संविधान रक्षकों !

एक -एक करके सारे मयंक खो दोगे ! तुम ! और जनता जी कोई नही लड़ेगा तुम्हारी लड़ाई ! संभाल लो, संभाल सकते हो ! यह बात गंभीर है।
