Senator Schumer’s new op-ed defending the No Kings Act. He relies on Ex Parte McCardle as precedent. But as @Alan_Trammell and I explained in the @WSJ yesterday, that case and others show why this won’t work. Link replies.

NEW: My and @Alan_Trammell's op-ed in the @WSJ, explaining why Sen. Schumer's "No Kings Act" wouldn't work to overturn Trump v. US, even if it could get through Congress.
It draws on our @ColumLRev article, "The False Promise of Jurisdiction Stripping.

Congress may not violate the Constitution and then try to cover it up through jurisdiction stripping. This is exactly what Schumer’s No Kings Act tries to do, write @danepps and @Alan_Trammell

Congratulations to our professors Carliss Chatman @carlissc and Alan Trammell @Alan_Trammell on receiving tenure and to Brandon Hasbrouck @b_hasbrouck and Carla Laroche @CarlaTheRock on their promotions to associate professor!
I’m very grateful to my students and colleagues for the honor of receiving the John W. Elrod Law Alumni Fellowship for teaching. And I’m happy to be sharing it with @b_hasbrouck!
Agreed that this is super weird. But the best values, by my lights, are John Paul Stevens and Harlan Fiske Stone at $4 apiece. (Notwithstanding his plodding writing style, Stone was arguably the greatest proceduralist on the Court in the first half of the twentieth century.)
Few things in life make you question the supposed glories of federalism more than sitting in the DMV for an hour, waiting to re-title an out-of-state car.
