Attributing corporate revenue or spousal assets as her personal "unexplained wealth" fails to meet the legal standard required for non-disclosure in Statements of Assets, Liabilities, and Net Worth (SALN).

* Methodological Discrepancies in Expert Testimony: During cross-examinations and hearings, key prosecution witnesses such as forensic financial expert Alexander Cabrera and representatives from the Bureau of Internal Revenue (BIR) faced pushback regarding missing records and raw data. The defense noted that certain financial summaries did not account for legitimate income streams, pre-existing family assets, or tax-paid business earnings over the multi-year periods in question.

* Lack of Direct "Ultimate Facts" Linking Misconduct: Under Philippine jurisprudence regarding unexplained wealth, the prosecution must show a clear, deliberate disparity between lawful income and actual accumulated assets that cannot be accounted for. The prosecution's evidence consists largely of circumstantial financial reports and bank transaction records rather than direct proof of illicit acquisition or intentional falsification of SALNs.

What Happens Next in the Trial?

With Luistro's announcement and the withdrawal of the other articles, the trial enters a streamlined phase:

* Formal Manifestation and Ruling: The Senate Impeachment Court must formally receive and acknowledge the prosecution's motion to withdraw Articles I, III, and IV. The Senate President and tribunal will issue an order officially limiting the scope of the trial solely to Article II (Unexplained Wealth / SALN Non-Disclosure).

* Defense Presentation and Cross-Examination: The prosecution will complete its remaining witness testimonyprimarily finalizing expert financial testimonies after which the defense will begin its cross-examination and present its counter-evidence.
