But it is not fulfilling our rights as workers because we are still excluded under the first schedule section 2(1), in which rest days, hours of work, sick leaves, etc. will not be applied to "domestic employees".
In Malaysia, domestic workers are left in forced labour situations, vulnerable to abuses and violence. Why? Under the Employment Act (1955), we are "servants" and are excluded from basic workers rights.
Scheduled for December 14th-16th 2021, the Parliament of Malaysia will carry out the second reading (2nd reading) of the Employment (Amendment) Bill 2021, and it is likely that it will be adopted soon. But, will it benefit "domestic workers"?
The main problems experienced by domestic workers in Malaysia:
Working for almost 24 hours/day
• No rest day
• Document retention
• Being isolated with no access to communication
• Unpaid salary
• Experiencing violence
The coming Employment (Amendment) Bill 2021 still excludes "domestic workers" from getting their basic rights such as: rest days, sick leaves, annual leaves, holidays, hours of work and some other protections.
